exemptian for use of uranium in storage casks.

"The use of natural or depleted uranium in spent fuel shipping casks is exempt

from the licensing requirements for source material under the provisions of 10 l

CFR 40.13(c)(6). This exemption does not apply to spent fuel storage casks.

Currently, natural or depleted uranium is not used in the design of storage casks; however, it is anticipated that designers will want to use this material in future cask designs. Multiple requests for exemptions can be expected to provide relief from the general license provisions under Part 40.

An exemption for the use of this material in storage casks would provide burden relief for both applicans and the staff."

l I have discussed the need for an EA with Don Cleary who is our resident EA l

guru. He offered the following two suggestions:

1 Look at the rulemaking that provided the current exemption for shipping casks and see if the environmental assessment could cover the proposed use for storage casks. However, the dates for the references at the end of the section range from 1961 to 1970 and I do not think that the staff was very interested in performing EA's during that time period, although a safety evaluation may be available.

2 Perform our own safoty evaluation and EA.

Don thinks that it may not be too difficult. However, he expects that it might draw some public comments and would be counter to a direct-final rule.
