Letter from TVA to NRC, CNL-24-001, "Browns Ferry Nuclear Plant Units 1, 2, and 3 - Application for Subsequent Renewed Operating Licenses," dated January 19, 2024 (ML24019A010, ML24019A011)

In the referenced letter, the Tennessee Valley Authority (TVA) submitted a Subsequent License Renewal Application for the Browns Ferry Nuclear Plant (BFN), Units 1, 2, and 3, Renewed Facility Operating Licenses in accordance with Title 10 of the Code of Federal Regulations (10 CFR), Part 54, Requirements for Renewal of Operating Licenses for Nuclear Power Plants. This application included Appendix E, Environmental Report - Operating License Renewal Stage, provided in accordance with 10 CFR 54.23. Pursuant to this application, TVA requested and was granted a waiver of the Clean Water Act (CWA), Section 401 Water Quality Certification for BFN by the Alabama Department of Environmental Management (ADEM). To facilitate future CWA communications, the NRC requested that the ADEM letter granting the waiver be provided on the BFN docket, and so is accordingly included as an attachment.

Dear Mr. Pearman:

The Water Quality Branch of the Alabama Department of Environmental Management (ADEM) has reviewed your request for a CWA Section 401 Water Quality Certification for Browns Ferry Nuclear Plant received via email on June 12, 2024. ADEM has determined that the NPDES permit will address any water quality concerns with the Browns Ferry Nuclear Plant located on the Tennessee River near Athens, Alabama; therefore, ADEM will waive the requirement for a 401 Water Quality Certificate as part of the NRC license renewal process.
