SUBJECT:

BRUNSWICK NUCLEAR GENERATING STATION - POSSIBLE WILLFUL VIOLATION OF REPORTING REQUIREMENTS This is to confirm o~ur telephone discussion of November 26, 1980 when I informed you that Region II had, during the course of an investigation into alleged reported releases to the atmosphere at the Brunswia NGS, developed information that has led both them and this writer to suspect a criminal violation on the part of the licensee, Carolina Power and Light (CP&L). According to the Region II investigator, Robert Marsh, their investigation has disclosed that there were a series of unreported releases of radioactivity to the environment during the early part of 1980, some in the form of gaseous effluvia and some in the form of contaminated water in a storage pond.

The pond in question is described as a " clean" pond in the Brunswick FSAR, yet allegedly has had radioactive water dumped into it over a two year period. Additionally, the investigation has reportedly turned up internal CP&L documents prepared by the CP&L staff that inform senior management of this apparent noncompliance with Commission requirements.

As I told you during our conversation, this office lacks specific details that you might need to make a referral determination. Consequently, I recommended that you contact Mr. Marsh directly to obtain any additional information that you may need.

As per our agreement, please keep us informed of any referral to D0J and/or any special handling instructions requested by them regarding this matter.
