Dear Mr. Narayanan:
As requested by your application dated February 15, 2018 (Agencywide Documents Access and Management System (ADAMS) Accession Number ML18053A220), as supplemented on June 14, 2018 (ADAMS Accession Number ML18178A029), August 30, 2018 (ADAMS Accession Number ML18255A124), February 19, 2019 (ADAMS Accession Number ML19058A410), March 21, 2019 (ADAMS Accession Number ML19084A054), June 19, 2019 (ADAMS Accession Number ML19176A315), July 16, 2019 (ADAMS Accession Number ML19204A228), July 17, 2019 (ADAMS Accession Number ML19220A177), August 29, 2019 (ADAMS Accession Number ML19248C254), and October 1, 2019 (ADAMS Accession Number ML19274B914), enclosed is Amendment No. 1 to Certificate of Compliance (CoC) No. 1042 for the NUHOMS EOS System. The amended certificate constitutes the U.S. Nuclear Regulatory Commissions (NRC) approval for use of the NUHOMS EOS System for storage of spent nuclear fuel under the general licensing provisions of 10 CFR Part 72, Subparts K and L, subject to the conditions in the amended certificate. This amendment revises the CoC for the NUHOMS EOS System to include the following changes: adds a new basket type (Type 4) to allow for the loading of intact, damaged, or failed fuel; adds another new basket type (Type 5) with low conductivity poison basket plates and low emissivity coated steel basket plates; accepts fuel assemblies with a minimum two-year cooling time, in selected locations within the basket; adds the NUHOMS MATRIX design as an alternative to the EOS horizontal storage module design for the storage of spent fuel; and makes additional revisions to the certificate of compliance and the technical specifications for consistency and clarity.

The NRC safety evaluation report for this amended CoC (including the CoC itself and Technical Specifications) is enclosed.
