Status of the Petition for Rulemaking, Returning a Decommissioning Plant to Operating Status (PRM-50-125)

Mr. Blind, I am writing to provide an update on the letter dated July 1, 2024, in which you submitted a petition for rulemaking to the U. S. Nuclear Regulatory Commission (NRC). In the petition, you requested that the NRC revise its regulations in 10 CFR Part 52, Licenses, Certifications, and Approvals for Nuclear Power Plants, to establish a Commission-approved process for returning a plant that has entered the decommissioning process to an operational status.

The NRC docketed the petition for rulemaking as PRM-50-125. The petition was docketed under 10CFR Part 50, Domestic Licensing of Production and Utilization Facilities, as the NRC understands the petition, based on the context and references within, to be referring to the Part 50 regulations.

The NRC published a notice with a request for comments in the Federal Register on September19, 2024 (89 FR 76750). The public comment period ended on December 3, 2024. The resulting submissions and your supplements have been posted on https://www.regulations.gov/document/NRC-2024-0135-0003. The NRC is making a determination on your petition for rulemaking. In accordance with 10 CFR2.803(h), this determination may be based upon the merits of the petition and the substance of any public comments received. Once the NRC has made a determination on the petition, a notice will be published in the Federal Register.
