Designation of Authorized Representative for United States Nuclear Regulatory Commission Special Nuclear Material Licenses Attached, please find a signed copy of Designation Order No. S1-DES-DOEID-2024, which designates the Manager for the Idaho Cleanup Project (ICP) to serve as my authorized representative pursuant to 10 CFR 72.16(b), including for the United States Nuclear Regulatory Commission (NRC) special nuclear material (SNM) licenses:
(1) SNM-2504, Fort St. Vrain Independent Spent Fuel Storage Installation (ISFSI); (2)
SNM-2508, Three-Mile Island 2 ISFSI; and (3) SNM-2512, Idaho Spent Fuel Facility.
This designation is assigned to the most senior Office of Environmental Management (EM) official located at the ICP office. The designation will become effective once the NRC approves license amendments identifying the changes made to the designation.
The designation is consistent with EMs programmatic responsibility for the operation of these facilities and is coordinated with the Office of Nuclear Energy.

DEPARTMENT OF ENERGY DESIGNATION ORDER NO. S1-DES-DOEID-2024 TO THE MANAGER FOR THE IDAHO CLEANUP PROJECT
- 1. DESIGNATION. Pursuant to the authority vested in me as the Secretary of Energy, I hereby designate the Manager for the Idaho Cleanup Project (ICP) as my authorized representative, as that term is used in the Nuclear Regulatory Commission (NRC) regulations at 10 CFR 72.l6(b) (entitled Oath or affirmation), including in all matters regarding NRC special nuclear material (SNM) licenses SNM-2504, SNM-2508, and SNM-2512, and future amendments thereto. The Manager for the ICP is designated as my authorized representative to take such action as is necessary and appropriate to perform the duties and responsibilities of his or her position, including, but not limited to, any responsibilities assigned by Departmental policies, standards, programs, organization and budgetary limitations, and prescribed administrative instructions. The Manager for the ICP shall coordinate NRC licensing actions that could amend the license and ensure that any such actions are concurred on by the Department of Energys (DOE) Office of the General Counsel and the Office of Environmental Management.
- 2. RECISSION. Designation Order No. 00-09.00A is hereby rescinded. Redesignation Orders 00-09-01A and 00-09-01-01A (S3-DES-EM1-2006 and EM1-DES-DOEID-2006) are hereby rescinded.
- 3. LIMITATION.
- a. In exercising this designated authority, the Manager for the ICP shall be governed by the rules and regulations of DOE or the NRC (per 3.b below), and the policies and procedures prescribed by the Secretary of Energy or the Commissioners of the NRC (per 3.b below), or by his or her delegates.
- b. The NRC is recognized as the legal regulatory authority with respect to the possession and management of materials under the subject licenses. Therefore, the NRC requirements that are within NRC's jurisdiction under section 202 of the Energy Reorganization Act of 1974 will apply to the licensing, design, construction, operations, and decommissioning of any facility subject to those licenses. DOE orders, regulations, and/or guidelines will apply where the NRC defers to DOE or does not exercise regulatory authority, or where the NRC does not have jurisdiction under section 202 of the Energy Reorganization Act of 1974.
- c. The Office of the General Counsel must concur in filings and responses to NRC concerning potential enforcement actions, requests to amend, renew, or terminate a license and applications for a new NRC license.
- d. Nothing in this Order shall preclude the Secretary from exercising any of the authority delegated by this Order.

- e. Nothing in this Order shall be construed to supersede or otherwise interfere with the authorities provided to the Administrator, National Nuclear Security Administration (NNSA) by law or by delegation. Furthermore, nothing herein constitutes authority to exercise authority, direction, or control of an employee of NNSA or its contractors.
- f. Any amendments to this designation shall be in consultation with the DOE Office of the General Counsel.
- 4. AUTHORITY TO REDESIGNATE. This designation may not be redesignated or delegated.
- 5. DURATION AND EFFECTIVE DATE.
- a. All actions pursuant to any authority provided prior to this Order or pursuant to any authority granted by this Order taken prior to and in effect on the date of this Order are ratified and remain in force as if taken under this Order, unless or until rescinded, amended, or superseded.
- b. A copy of this Order shall be provided to DOEs Office of Management, which manages the Secretarial Delegations of Authority System.
- c. This Designation Order is effective 07/22/2024. For each license referenced in paragraph 1 above, this Designation Order will become effective once the NRC approves a license amendment identifying this designation.
