F. Schroeder, Acting Director, Division of Technical Review In the recent meeting with PG & E on Diablo Canyon, we agreed to try to expedite USGS release of the offshore data of Silver.
We have since made repeated requests to Fred Houser, USGS, to either release the report, let us talk to Silver informally, or permit us to emine the raw data ourselves to determine its safety significance. This morning he flatly stated that policy prohibited any eusmination or discussions with us until formal report release. He said he was doing all he could to move the report along but could not give any firm date for I
when it would be available.
I indicated to him that in my opinion, it was irresponsible public policy for one federal agency to withold from examin-ation factual data which another federal agency needed to carry out its statutory responsibilities. Since I see no basis for exempting from public disclosure the type of records at issue, I also indicated that witholding raw data appeared

at variance with the freedom of information act.
l I also discussed with Houser a proposal agenda of other policy meMj!
matters and anticipate that a management meeting with Dr. Coultar j
can be arranged next week.

C STATT REPORT FOR HIE WEEK ENDING MAR 018,1975 PACIFIC GAS AND ELECIRIC COMPANY DIABID CANYON UNITS 1 AND 2 DOCITr NOS. 50-275/323 During the CP review, we and our consultants, USGS, concurmd with the applimnt's selected geological and seismological bases for design. This imlnded an SSE of 0.4g.
New information has beccme available during the I'
course of the OL review which causes the staff to tentatively conclude 5

that an SSE value of 0.5g would be appropriate for the site. We determined ll that the as-built facility would be able to withstand such an acceleration.

The USGS letter which ms received 1/28/75 states that an acceleration in excess s
l of 0.5g is more appropriate for this site. We met with the applicant and the i
l USGS on 2/7/75 to discuss this subject. The applicant tes requested to I
i supply additional inforuation by 3/1/75 in an attenpt to resolve this issue.

i A meeting was held with the applimnt's top management on 3/3/75 to discuss further avenues they might pursue. Resolution of this problem will impact W ;.
