SUBJECT:

PROMULGATION OF RECOMMENDATION ON OIA INQ 85-15 Your recommendation in this report recommended a ' reminder' of the region involved.

That strikes me as unnecessary - maybe even counter productive - in view of the fact that current Regional management was not in place at the time of this event, and because it appears that in the case at hand, the allegation was publicly available through the ASLBP Hearing.

My first inclination, therefore, was to decline the invitation to dance.

On reading MC 0702-03, however, I find no guidance on notifying OIA, and withholding notification of individuals concerned.

It seems logical to provide everybody some guidance on that point and I would proposa the wording in the attached draft memo.

I would appreciate both your approval or comments on this approach and your comments on the content of '.he draft memo, i.e., does it cover the grou6d correctly and fully.

I would also recomend you revise the Manual Chapter.

'An incident occurred some time ago in which an NRC employee, accused of misconduct, was advised of an allegation directly several weeks before OIA was notified.

OIA has expressed concern that such action hampers their investigation. While I believe this was an isolated and unique instance, I caution you to be careful to consult with/ notify OIA before advising NRC persons involved in an allegation or before making them aware of the issue indirectly by actio0s such as "uncoded" entry in the allegation tracking system.
