This refers to the routine inspection conducted by Mr. J. M. Dunlap of this
office on November 29 - December 3, 19 C , at Buchanan, New York, of activities
authorized by NRC License No. DPR-26 and to the discussions of our findings
held by Mr. Dunlap with Mr. Michael Blatt of your staff at the conclusion of
the inspection.
Areas examined during this inspection are described in the NRC Region I
Inspection Report which is enclosed with this letter. Within these areas, the
inspection consisted of selective examinations of procedures and representative
records, interviews with personnel, and observations by the inspector.
Based on the results of this inspection, it appears that one of your activities
was not conducted in full compliance with NRC requirements, as set forth in the
Notice of Violation, enclosed herewith as Appendix A.
This violation has been
categorized by severity level in accordance with the NRC Enforcement policy (10 CFR 2, Appendix C) published in the Federal Register Notice (47 FR 9987) dated
March 9, 1982. You are required to respond to this letter and in preparing
your response, you should follow the instructions in Appendix A.
Sections of the enclosed inspection report contain details of your security
program that have been determined to be exempt from public disclosure in
accordance with either 10 CFR 73.21 (Safeguards Information) or
10 CFR 9.5(a)(4) (commercial or financial information).
Therefore, the
sectiors so identified in the inspection report and Appendix A will not be
placed in the NRC Public Document Room and will receive limited distribution.
The inspection report cover sheet and any remaining portions of the inspection
report will be placed in the Public Document Room, in accordance with 10 CFR 2.790(a), unless you notify, by telephone, the Supervisor, Files, Mail and
Records, USNRC Region I, at (215) 337-5223, within 10 days of the date of this
letter and submit written application to withold information contained in the
report within thirty days of the date of this letter.
Such application must
be consistent with the requirements of 10 CFR 2.790(b)(1).
