Dear Congressman Hall:

I eppreciate the opportunity to comment on your letter of April 29 concerning the Nuclear Regulatory Cermiission's policy concerning

-the release of informbtion concerning proposed imposition of civil penalties.

The practice.of informing the public of proposed enforcement actions began with' the Atomic Energy Commission and has been continued by the Nuclear Regulatory Commission.

This practice is based, in part, on the premise that public confidence that radioactive materials can be handled safely and properly is enhanced by public awareness of the activities of the agency charged with regulating in the public interest.

The NRC will impose civil penalties when violttions are considered sufficiently serious to warrant actions in mss-of remedial efforts.

Thus, the penalties reflect actual, rather than technical. violations of tht NRC's regulations.

Our policy of issuirrg public statements of

proposed enforcement ac.tions reflects our view of the importance of the violation.

I would note that t.he staff has not determined the appropriate enforcement action in'the' case 6f Grandview Hospital.

However, publication of any proposed civil penalty concerning Grandview Hospital wou-id be consistent with our policy of informing the public of significant matters.

If, in fact, a civil penalty is proposed, a public announcement will be issued from our office in Glen Ellyn, Illinois, and that announcement will reflect accurately th? contents of the. transmittal letter and notice of proposed imposition.

As you may be aware, these formal documents also will be sent to the NRC's public document file at the same time, or shortly after, they are sent to the licensee.

We appreciate your interest in this matter and, if we can provide you with additional information, please do not hesitate to let us know.
