Vogan ACRS 10 E. Rossi H. Denton/D. Eisenhut Your letter of February 14, 1986 informed us that the calculated ECCS performance for the Diablo Canyon Unit 2 is not based on the actual plant conditions.

Your letter also provided substantial information demonstrating that operation of the facility is safe.

After discussions with the staff, your letter of February 21, 1986 requested an exemption from the provisions of 50.46(a)(l) requiring ECCS performance to be calculated on a plant specific basis using an approved evaluation model until such time as the revised Unit 2 specific calculations are completed.

Your letters provide sufficient information to demonstrate that operation of the plant will remain within the limits of the acceptance criteria of 10 CFR 50.46(b) while the revised Unit 2 specific calculations are performed.

It also provides information to support the requested exemption.

Until the requested exemption can be processed by the staff, a matter of a few days, a temporary waiver is warranted.

Accordingly, we hereby grant a

temporary waiver until March 4, 1986, unless sooner superseded by issuance of an exemption or other Order of the Commission.

This waiver is contingent on operation with a heat flux hot channel factor, Fq, not to exceed 2.30 and all other conditions in conformance with License No.

DPR-82 and the associated Technical Specifications.
