TURKEY POINT NUCLEAR GENERATING UNIT NOS. 3 AND 4 - STATUS OF SUBSEQUENT LICENSE RENEWAL APPLICATION (EPID NO. L-2018-RNW-0002)

By letter dated January 30, 2018, (Agencywide Documents Access and Management System (ADAMS) Package Accession No. ML18037A812), Florida Power & Light Company (FPL) submitted an application for subsequent license renewal of Renewed Facility Operating License Nos. DPR-31 and DPR-41 for the Turkey Point Nuclear Generating Unit Nos. 3 and 4 to the U.S. Nuclear Regulatory Commission (NRC or staff). The application included information to be withheld in accordance with Title 10 of the Code of Federal Regulation (10 CFR) Section 2.390, "Public inspections, exemptions, requests for withholding," which required the U.S. Nuclear Regulatory Commission (NRC) staff to conduct a proprietary review in accordance with 10 CFR 2.390.

During the proprietary review, the U.S. Nuclear Regulatory Commission (NRC) staff identified inconsistencies among the affidavits, the non-proprietary version of the application, and the proprietary version of the application, which required FPL to submit a supplement, dated February 9, 2018. The NRC staff also identified inconsistencies within the non-proprietary version of the application regarding what information was identified as proprietary and what was not. In following up on the staff's questions, FPL also identified incorrectly marked proprietary information. As a result, FPL submitted a second supplement to the application, dated February 16, 2018. Finally, the NRC staff asked questions about why information was being withheld because the staff believed the application contained sufficient information to calculate the information which was being withheld. As a result, FPL submitted a third supplement to the application, dated March 1, 2018.

In order to reduce confusion, note that FPL uses similar but different nomenclature to identify proprietary information in the non-proprietary application and the proprietary application. In the non-proprietary application, FPL uses "Withheld from Public Disclosure Under 10 CFR 2.390" to indicate the pages that contain proprietary information that is withheld (empty E. Oesterle brackets). In the proprietary version, FPL uses "Withhold from Public Disclosure Under 10 CFR 2.390," to indicate pages that contain the actual proprietary information.
