%...../

December 11, 1996 Mr. Joseph J. Hagan Vice President, Operations GGNS Entergy Operations, Inc.

P. O. Box 756 Port Gibson, MS 39150 2

SUBJECT:

REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE IN A MATTER FOR GRAND GULF NUCLEAR STATION, UNIT 1 (TAC NO. M95385)

Dear Mr. Hagan:

By your letter dated October 22, 1996, and the General Electric Company (GE) affidavit dated October 17, 1996, executed by Ralph J. Reda, you submitted Entergy document, " Clarifications to NRC Request for Additional Information i

(RAI) Regarding GGNS Proposed Amendment to the Operating License" dated August 30, 1996, and requested that those portions of the document owned by GE and marked by " bars" drawn in the margin of the text be withheld from public disclosure pursuant to 10 CFR 2.790. The other proprietary portions of the document requested to be withheld from public disclosure will be the subject of a later letter.

In the affidavit, GE stated that the submitted information should be r

considered exempt from mandatory public disclosure for the following reasons:

a "Some examples of categories of information which fit into the definition of proprietary information are:

a.

Information that discloses a process, method, or apparatus, j

including supporting data and analyses, where prevention of its use by General Electric's competitors without license from General Electric constitutes a competitive economic e

advantage over other companies; b.

Information which, if used by a competitor, would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing of a similar product;"

In addition:

"The information identified in [the GE document above) is classified as proprietary because it contains details of GE's h

Safety Limit MCPR analysis and the corresponding results which GE has applied to GGNS's actual core design with GE's Gell fuel, i

The development cf the methods used in these analysis, along with the testing, development and approval of the supporting critical power correlation was achieved at a significant cost, on the order d

of several million dollars, to GE."

We have reviewed your application and the material in accordance with the i

requirements of 10 CFR 2.790 and, on the basis of the statements in your letter, have determined that the submitted information sought to be withheld j

contains proprietary commercial information.

Therefore, the applicable portions of the document marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

i i

Withholding from public disclosure shall not affect the right, if any, of i

persons properly and directly concerned to inspect the document.

If the need i

arises, we may send copies of this information to our consultants working in i

this area. We will, of course, ensure that the consultants have signed the l

appropriate agreements for handling proprietary information.

I If the basis for withholding this information from public disclosure should j

change in the future such that the information could then be made available for public inspection, you should promptly notify the Nuclear Regulatory 4

Commission (NRC).

You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes this information.

In all review 1

situations, if the NRC makes a determination adverse to the above, you will be j

notified in advance of any public disclosure.

l Sincerely, b

M
