Dear Mr. Pacilio:
On April 1, 2011, the U. S. Nuclear Regulatory Commission (NRC) completed a team inspectionat your Oyster Creek Nuclear Generating Station. The enclosed inspection report documentsthe inspection findings, which were discussed on April 1 ,2011, with Mr. Michael Massaro, SiteVice President, and other members of your staff. A follow-up discussion to provide an update ofthe inspection findings was held with Mr. J. Chrisley by telephone on April 28, 2011.The inspection examined activities conducted under your license as they relate to yourpreparedness to handle large fires or explosions by verifying you continue to meet therequirements of your 8.5.b license conditions and 10 CFR 50.54 (hhx2). Within these areas,the inspection involved examination of selected procedures and records, observation ofactivities, and interviews with station personnel.This report documents one NRC-identified finding of very low safety significance (Green) whichinvolved a violation of NRC requirements. However, because of the very low safety significanceand because the issue was entered into your corrective action program, the NRC is treating thisfinding as a non-cited violation (NCV) consistent with Section 2.3.2 of the NRC EnforcementPolicy. lf you contest this NCV, you should provide a response within 30 days of the date of thisinspection report, with the basis for your denial, to the Nuclear Regulatory Commission, ATTN.:Document Control Desk, Washington DC 20555-0001; with copies to the RegionalAdministrator, Region l; the Director, Office of Enforcement, United States Nuclear RegulatoryCommission, Washington, DC 20555-0001; and the NRC Resident Inspector at Oyster CreekNuclear Generating Station. In addition, if you disagree with the characterization of the findingin this report, you should provide a response within 30 days of the date of this inspection report,with the basis for your disagreement, to the Regional Administrator, Region l, and the NRCResident Inspector at Oyster Creek Nuclear Generating Station. The information you providewill be considered in accordance with Inspection Manual Chapter 0305.Enclosure contains Sensitive UnclassifiedNon-Safeguards Information.
