REPLYTOANOTICEOFVIOLATION;EA-10-255INSPECTIONREPORTNOS.50-280/2011-012AND50-281/2011-0121.ReasonfortheViolation,or,ifContested,theBasisforDisputingtheViolationorSeverityLevelVirginiaElectricandPowerCompany(Dominion)doesnotcontesttheviolation.Basedupontheconclusionsofacompanyinitiatedinvestigation,alaborerwhowasassignedfirewatchdutiesonMay4andMay5,2010foraffectedareasoftheplantintheUnit1EmergencySwitchgearRoom(ESGR),Unit2ESGR,Unit1CableVaultlTunnel,andUnit2CableVaultlTunnel,failedtocompletethefirewatchroundsandwillfullydocumentedthecompletionoftheseroundsinfirewatchlogs.Thisindividualhadbeenproperlytrainedandqualifiedtoconductfirewatches.Hewasbriefedbyhissupervisorsontheduties,responsibilities,andexpectationsforconductinganddocumentingfirewatches,andpriortoperformingfirewatches,thelaborerhadbeenbriefedonthestatusandassignmentofthefirewatches.Asaresultofthecompanyinvestigation,Dominionconcludesthattheindividualunderstoodhisduties,responsibilities,andexpectations,butchosetoviolateDominionpoliciesandprocedures,includingtheFireProtectionProcedure.2.CorrectiveStepsWhichHaveBeenTakenandtheResultsAchievedUpondiscoveringthelaborer'smisconductonMay5,2010,anoperatorwasproperlybriefedandassumedthefirewatchrequirementsfortheaffectedareas.ThelaborerwasescortedoutoftheProtectedAreaandhisbadgewasdeactivated.Thecompanyinitiatedaninvestigationtodetermineanddocumenttheextentofthelaborer'smisconduct.TheinvestigationconcludedthattheoccurrencesextendedbacktoSeptember2009andoccurredonnightsandweekendshiftswhennodirectsupervisionwaspresent.Theindividualremainedoffsiteduringtheinvestigationandafterthecompletionoftheinvestigation,thelaborer'semploymentwasterminated.Theinvestigationalsoreviewedtheperformanceofotherworkersusedforfirewatchduties,butdidnotfindthatanyotherworkersengagedinmisconductwithrespecttotheirassignedfirewatchduties.Managementconfirmedtheresultsoftheinvestigationbycomparingkeycardentryrecordswithfirewatchlogsandidentifiednoadditionalcasesofmisconduc Managementmetwithworkersassignedfirewatchdutiestoreiterateexpectationsregardingtheperformanceoffirewatchduties,aswellasremindingthemoftheirdutytoreportviolationsofpolicyorprocedures,theresponsibilitytoreporttoworkfitforduty,andtheirdutytoreportfitnessforduty(FFD)issues.Itwascommunicatedthatcompliancewiththeseexpectationsmaintainsemployeetrustworthinessandisaconditionofunescortedaccesstothestation.3.CorrectiveStepsWhichWillbeTakentoAvoidFurtherViolationsManagementwillcontinuetoperiodicallyverifytheperformanceofworkersassignedfirewatchdutiesonbackshiftsandweekendswhensupervisionisnotpresentbyreviewingfirewatchlogsrecordsordirectobservations.4.TheDateWhenFullComplianceWillbeAchievedFullcompliancehasbeenachieved.
