SUBJECT: ANNUAL ASSESSMENT LETTER FOR NINE MILE POINT NUCLEAR STATION(RE PO RT 05000220 t20 1 000 1 AN D 05000 41 0 tzo 1 0001 )

Dear Mr. Belcher:

On February 9,2011, the Nuclear Regulatory Commission (NRC) completed its end-of-cycleperformance review of Nine Mile Point Nuclear Station (NMPNS), Units 1 and2. The NRCreviewed the most recent quarterly performance indicators (Pls) in addition to inspection resultsand enforcement actions from January 1,2010, through December 31,2010. This letter informsyou of the NRCs assessment of your facility during this period and its plans for futureinspections at your facility. This performance review and enclosed inspection plan do notinclude security information. A separate letter will include the NRCs assessment of yourperformance in the Security Cornerstone and its security-related inspection plan. The NRC determined that overall, NMPNS Units 1 and2 operated in a mannerthat preservedpublic health and safety and met all cornerstone objectives. The NRC determined theperformance at NMPNS Units 1 and 2 during the most recent quarter was within the LicenseeResponse column of the NRCs Reactor Oversight Process (ROP) Action Matrix, because allinspection findings had very low (i.e., green) safety significance, and all Pls indicated that yourperformance was within the nominal, expected range (i.e., green). On March 25,2010, the NRC completed a supplemental inspection for a White Pl, associatedwith high unavailability of service water pumps, and determined that NMPNSs actionsaddresling these issues were appropriate. The inspection was conducted using InspectionProcedure (lP) 95001, "lnspection for One or Two White Inputs in a Strategic Performance Areai'and the results were documented in inspection report 05000410/2010006. Therefore, the WhitePlwas removed from the assessment process resulting in NMPNS transitioning from theRegulatory Response Column to the Licensee Response Column of the NRCs Action Matrix intheleconi quarter of 2Q10. The NRC plans to conduct ROP baseline inspections at NMPNSUnits 1 and2.The enclosed inspection plan details the inspections, less those related to physical protection, scheduled through June 30, 2012. Routine inspections performed by resident inspectors arenot included in the inspection plan. The inspections listed during the last nine months of theinspection plan are tentative and may be revised at the mid-cycle performance review. TheNRC provides the inspection plan to allow for the resolution of any scheduling conflicts andpersonnel availability issues. ln addition to the baseline inspection program, we plan to conductinspection Procedure 60853,'On-Site Fabrication of Components and Construction of anlndependent Spent Fuel Storage Installationl' We also plan on conducting Inspection Procedure S. Belcher71004,"Power Upratei'regarding NMPNS Unit 2 power uprate activities. The NRC will contactyou as soon as possible to discuss changes to the inspection plan should circumstanceswarrant any changes. From January 1 to December 31,2010, the NRC issued one severity level lVtraditionalenforcement non-cited violation that involved a willful act. Therefore, the NRC plans to conductInspection Procedure 927O2,"Followup on Traditional Enforcement Actions including Violations,Deviations, Confirmatory Action Letters, Confirmatory Orders, and Alternative DisputeResolution Confirmatory Ordersl'to follow-up on this violation. In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will beavailable electronically for public inspection in the NRC Public Document Room or from thePublicly Available Records (PARS) component of NRC's document system (ADAMS). ADAMSis accessible from the NRC Web site at http:iirnnnrw.nrc.qov/readinq-rm/adams.html (the PublicElectronic Reading Room). Please contact Glenn Dentel of my staff at 610-337-5233 with any questions you have regardingthis letter.
