SUBJECT: WATTS BAR NUCLEAR PLANT NON-CITED VIOLATION 05000390/2008005- 04, CARBON DIOXIDE SYSTEM IN FIRE AREA 48 FAILED TO MEET DESIGN CRITERION
Dear Mr. Swafford:
We have received your response to our Non-Cited Violation (NCV)05000390/2008005-04, "Carbon Dioxide System in Fire Area 48 Failed to Meet Design Criterion," issued in NRC Inspection Report 05000390/2008005 (ADAMS Accession No. ML090440261), dated March 24, 2009, in which you denied this NCV. The basis for your denial is currently under review by the staff. Upon completion of this review, TVA will be advised of the results.
In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter, and your response (if any) will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS)
