Dear Mr. Weiss:

Public Service Company of Colorado (PSC) submitted a license amendment application in Reference 1) which stipulated that the Fort St.

Vrain (FSV) reactor would not be operated above 2% of full power for electric power production af ter ilugust 18, 1989.

During the week of November 13, 1989, Mr. Peter Erickson of your office expressed i

concern that the 2*4 reactor power restriction is inconsistent with information in the Defueling Safety Analysis Report transmitted to the NRC by Reference 2). This report considered reactor criticality to be incredible during defueling.

In respont.e to this concern, PSC committed to submit a license amencment to further restrict taking the FSV reactor critical.

T PSC has no intention of taking the FSV reactor critical again.

PSC hereby commits to net take the FSV reactor critical or operate the reactor at any power level.

This letter submits a proposed amendment to Facility Operating License No.

OPR-34 which will revise the license to read, "The licensee is not authorized to operate the reactor at any power level." This submittal supersedes the previous license amendment application transmitted by Reference 1).
