PEACH BOTTOM GENERATING STATION - NRC INSPECTION REPORT 05000277/2007403 AND 05000278/2007403

Dear Mr. Crane:

On February 28, 2007, the United States Nuclear Regulatory Commission completed an inspection at your Peach Bottom Generating Station Units 2 and 3. This inspection examined activities conducted under your license as they relate to common defense and security, and to compliance with the Commissions Security Order. The inspection was based upon Temporary Instruction (TI) 2201/001 - Inspection of Additional Security Measures for Radioactive Material Quantities of Concern (RAMQC). The inspection results were discussed on February 28, 2007, with Mr. Joseph Grimes and other members of your staff.

Based on the results of this inspection, no violations were identified. No reply to this letter is required.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter, its enclosure, and your response (if any) will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component for the NRCs document system (ADAMS). .1 (Closed) NRC Temporary Instruction (TI) 2201/001 - Inspection of Additional Security Measures for Radioactive Material Quantities of Concern (RAMQC)

a. Inspection Scope (TI 2201/001)

The inspectors reviewed the RAMQC program to determine the licensees ability to implement the additional security measures (ASMs) imposed by U.S. NRC Order EA-05-007, Imposing Additional Security Measures on the Transportation of RAMQC, issued July 19, 2005. The inspectors also reviewed the program to verify that the Safeguards Information-Modified Handling (SGI-M) protection requirements specified in NRC Order EA-04-0191, Imposing Requirements for the Protection of Certain Safeguards Information, issued November 5, 2004, have been successfully incorporated into Exelons information protection strategy.

On February 28, 2007, the inspectors covered each ASM and SGI-M requirement. The inspectors reviewed licensee verifications; background investigations; preplanning and coordination; notifications; communications; drivers and accompanying individuals; procedures; and training and control of information. The inspectors conducted the inspection through interviews with responsible personnel and a review of programmatic and implementing procedures, including associated records and documentation.

The inspectors completed one of the required one sample.

b. Findings and Observations No findings of significance were identified.

c. Conclusions The inspectors concluded that Exelons personnel maintained an effective RAMQC program. Exelon personnel effectively implemented the ASMs imposed by U.S. NRC Order EA-05-007, Imposing Additional Security Measures on the Transportation of RAMQC, issued July 19, 2005. The inspectors also concluded that Exelon personnel successfully incorporated the information protection strategy per the SGI-M protection requirements specified in NRC Order EA-04-0191, Imposing Requirements for the Protection of Certain Safeguards Information, issued November 5, 2004.

40A6 Meetings, Including Exit Exit Meeting Summary On February 28, 2007, the NRC inspectors presented the inspection results to Mr. Joseph Grimes and staff members. Although proprietary and safeguards Enclosure

information was reviewed, the NRC inspectors confirmed that proprietary and safeguards information was not included in this inspection report.
