The NRC provides the inspection plan to allow for the resolution of any scheduling conflicts and personnel availability issues. As discussed in the End-of-Cycle letter dated March 2, 2016, the NRC will be following up on the following traditional enforcement actions to Millstone: EA-14-126, a Severity Level III Notice of Violation for impeding the regulatory process issued February 10, 2015; EA-13-188, an Alternative Dispute Resolution Confirmatory Order issued August 26, 2015; and a Severity Level IV violation for impeding the regulatory process issued on June 12, 2015. In accordance with Inspection Manual Chapter 0305, Sections 13.02.a and 13.02.b, the NRC will follow-up on these violations through Inspection Procedure 92702, Follow-up on Traditional Enforcement Actions Including Violations, Deviations, Confirmatory Action Letters, Confirmatory Orders, and Alternative Dispute Resolution Confirmatory Orders. | |||
The NRC staff received the Millstone Final Compliance letter for Order EA-12-049, Order Modifying Licenses with Regard to Requirements for Mitigation Strategies for Beyond-Design-Basis External Events, and Order EA-12-051, Order Modifying Licenses with Regard to Reliable Spent Fuel Pool Instrumentation. The NRC staff issued the Millstone Safety Evaluation on July 1, 2016 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML16099A171) and will confirm full implementation of the orders mentioned above by performing Temporary Instruction 2515-191, Inspection of the Implementation of Mitigation Strategies and Spent Fuel Pool Instrumentation Orders and Emergency Preparedness Communication/Staffing/Multi-Unit Dose Assessment Plans. | |||
In Staff Requirements Memorandum - SECY 16-0009, Recommendations Resulting from the Integrated Prioritization and Re-Baselining of Agency Activities, (ADAMS Accession No. ML16104A158) the Commission approved the NRC staff recommendation to discontinue the formal mid-cycle assessment process beginning in calendar year 2017. This will be the final mid-cycle assessment letter. The staff will continue to conduct assessment reviews and communicate changes in the assessment of licensee performance quarterly, and will also issue end-of-cycle assessment letters. | |||
