D. G. Eisenhut (US NRC) letter to L. V. Maurin (LP6L) dated September 30, 1981
Dear Sir:
forth in Reference (1) indicated that " compliance with the requirements set Appendix R as modified with accepted exceptions" will be made a licensing condition for Waterford 3.
?.lthough 10CFR50 Appendix R is a rule which applies strictly to nuclear power facilities operating prior to January 1, 1979, we have been discussing actively with NRC staff the Appendix R guiuance criteria used in their review of the fire These protection program and fire protection system at our Waterford 3 plant.
discussions have consisted of numerous telephone conversations with the NRC staff, meetings in NRC's Bethesda offices in June, July, August and October, We have also and a site audit /walkdown on September 9-10 of this calendar year.
informally submitted a proposed draft FSAR Appendix 9.5A, which indicates, via a Safe Shutdown Analysis, how Appendix R criteria are met by either the present WSES-3 design or by proposed design changes. We appreciate the dialogue provided by NRC in their attempts to clarify and resolve this item.
1 and based Therefore, in response to the Notification enclosed with reference on our past and ongoing discussions, we intend to comply with the " requirements" We will forth in Appendix R to 10CFR50, as modified by accepted exceptions.
set forth below.
formally document this commitment in two parts as set

Reference 2 states that all. fire protection features be implemented prior to fuel loading scheduled.for October'1982. It is our intention to identify any.
