Office of Nuclear Reactor Regulation Items of Interest Week Ending July 19, 2024 X-energy On July 15, 2024, the staff held a closed meeting with X-energy to discuss the overall civil and structural analysis methodology, which is tied to Xe-100 design changes to support Project Long Mott. X-energy discussed their intended process for developing risk-informed, performance-based structural design criteria following the Licensing Modernization Project process.
Reactor Oversight Process Public Meeting On July 17, 2024, the U.S. Nuclear Regulatory Commission (NRC) staff hosted a public meeting related to the Reactor Oversight Process (ROP) to discuss the development and planned implementation of a guide related to the concept of best-available information in the Significance Determination Process (Agencywide Documents Access and Management System (ADAMS)
Accession No. ML24193A342), the treatment and communication of greater-than-Green Performance Indicators (PIs) in the ROP (ML24184A170), and initial insights following the first use of the Operating Experience Smart Sample on Probabilistic Risk Assessment Configuration Control. NRC staff acknowledged receipt of a white paper related to clarifications to the unplanned scrams PI (ML24185A209) and proposed next steps in the ongoing NRC staff review of draft NEI 99-02, Regulatory Assessment Performance Indicator Guideline, Revision 8.
Industry representatives provided insights into proposed topics for the next cycle of Focused Engineering Inspections. Attendees included representatives from NEI, the industry, and members of the public. The next bi-monthly public meeting on ROP-related matters is tentatively scheduled for September 25, 2024.
Palo Verde Nuclear Generating Station On July 17, 2024, staff issued license amendment No. 223 to Palo Verde Nuclear Generating Station, Units 1, 2, and 3 using the Risk Informed Process for Evaluations (RIPE). Staff approved the licensees request to modify the Completion Time for the Limiting Conditions for Operation (LCOs) of Technical Specifications 3.5.1 and 3.5.2 related to the safety injection tanks from 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> to 10 days and delete the second case of Condition A for those LCOs. This was NRRs first approval of the RIPE process for a license amendment request.
X-energy On July 17, 2024, staff held a partially closed meeting with X-energy to discuss sharing of structures and systems, which is tied to Xe-100 design changes to support Project Long Mott.
X-energy discussed how they are using the Licensing Modernization Project process to demonstrate that certain structures and systems can be shared between nuclear power units.
Kairos Power LLCs On July 19, 2024, the staff issued its safety evaluation (SE) for Kairos Power LLCs construction permit (CP) application for its Hermes 2 non-power test reactor facility located in Oak Ridge, Tennessee. The SE was completed 4 months ahead of the 14-month review schedule. In addition, the staffs final Environmental Assessment (EA) is on track to be issued in August JULY 24, 2024 ENCLOSURE C
2024. The staff leveraged the recently completed Hermes 1 CP application review to identify efficiencies in the review and, as a result, the total resources for the review and issuance of the SE and EA are anticipated to be less than 60 percent of the original estimate.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending July 19, 2024 Miscellaneous Corrections; Final Rule; 10 CFR Parts 50, 52, and 54 [NRC-2024-0091; RIN 3150-AL15]
On July 16, 2024, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (89 FR 57717) amending its regulations to make miscellaneous corrections.
These changes include clarifying language and correcting grammatical and typographical errors, punctuation, references, and terms. This document is necessary to inform the public of these non-substantive amendments to the NRCs regulations. This final rule is effective on August 15, 2024.
American Society of Mechanical Engineers Code Cases and Update Frequency; Final Rule; 10 CFR Part 50 [NRC-2018-0291; RIN 3150-AK23]
On July 17, 2024, the NRC published a notice in the Federal Register (89 FR 58039) amending its regulations to incorporate by reference revisions of three regulatory guides to approve new, revised, and reaffirmed code cases published by the American Society of Mechanical Engineers (ASME). This action allows nuclear power plant licensees and applicants for construction permits, operating licenses, combined licenses, standard design certifications, standard design approvals, and manufacturing licenses to use the code cases listed in these regulatory guides as voluntary alternatives to engineering standards for the construction, inservice inspection, and inservice testing of nuclear power plant components. These engineering standards are set forth in the ASME Boiler and Pressure Vessel Code and ASME Operation and Maintenance Code, which are currently incorporated by reference into the NRCs regulations. Further, this final rule announces the availability of a related regulatory guide, not incorporated by reference into the NRCs regulations, that lists code cases that the NRC has not approved for use. Finally, this rulemaking provides more flexibility to licensees by expanding the code of record interval from ten years to two consecutive inservice testing and inservice inspection intervals. This final rule is effective on August 16, 2024.
