Office of Nuclear Reactor Regulation Items of Interest Week Ending July 12, 2024 Aalo Holdings, Inc.

On July 10, 2024, Aalo Holdings, Inc., submitted its initial Regulatory Engagement Plan (REP) for its Idaho Nuclear Project (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24193A003), initially consisting of seven 10MWe, sodium-cooled reactors using U-Zr-H fuel. The reactors are designed to share control room and secondary generating systems. The REP generally describes Aalos business model, a submittal schedule, and other pre-application activities, including potential white paper topics to address design features. Aalo plans to submit a Combined License Application as early as Q2 of CY2026.

Electric Power Research Institute (EPRI) Technical Report On July 11,2024, the U.S. Nuclear Regulatory Commission (NRC) accepted for review Electric Power Research Institute (EPRI) Technical Report 3002025288, Enhanced Risk-Informed Categorization Methodology for Pressure Boundary Components, (ML23352A054). The EPRI technical report was submitted on August 17, 2023 (ML23234A266), supplemented on November 30, 2023 (ML23334A210), and supplemented on June 28, 2024 (ML24180A016).

Public Meeting with Southern Nuclear Operating Company On July 11, 2024, staff held a public meeting with Southern Nuclear Operating Company (SNC) to discuss technical and regulatory information related to the NRCs non-acceptance (ML24178A376) of SNCs proposed license amendment request (ML24110A126) to revise TS 3.6.5, Containment Air Temperature, at Joseph M. Farley Nuclear Plant, Units 1 and 2, using the Risk-Informed Process for Evaluation (RIPE). During the meeting, SNC stated that it plans to resubmit the amendment request on July 19, 2024, outside of the RIPE process. SNC is requesting an expedited review (i.e., 30-60 days) because of anticipated increased summer temperatures.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending July 12, 2024 U.S. Nuclear Regulatory Commission (NRC) Revises 10 CFR Part 50 to Incorporate by Reference Revisions of Three Regulatory Guides to Approve New, Revised, and Reaffirmed Code Cases Published by the American Society of Mechanical Engineers On July 5, 2024, the U.S. Nuclear Regulatory Commission (NRC) Director of the Office of Nuclear Reactor Regulation signed a final rule (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23291A331) that revises 10 CFR Part 50 to incorporate by reference revisions of three regulatory guides to approve new, revised, and reaffirmed code cases published by the American Society of Mechanical Engineers. Further, the final rule announces the availability of a related regulatory guide, not incorporated by reference into the NRC's regulations, that lists code cases that the NRC has not approved for use. Finally, the rulemaking provides more flexibility to licensees by expanding the code of record interval from ten years to two consecutive inservice testing and inservice inspection intervals. The rule will be forwarded to the Office of the Federal Register on or about July 9, 2024, and will publish on or about July 15, 2024.

Public Meeting to Discuss Environmental Review Process and Solicit Environmental Scoping Comments on Holtecs Application to Restart the Palisades Nuclear Plant On July 11, 2024, the NRC and representatives from the DOE Loan Programs Office held a hybrid public meeting to describe the environmental review process and solicit environmental scoping comments on Holtecs application to restart the Palisades Nuclear Plant in Covert, MI. Approximately 100 people attended the meeting in-person and 85 people participated virtually. Public scoping comments focused on waste storage and transportation, radiation health and accidents, cost-benefit analysis of restarting the plant, extending the scoping public comment period, developing an Environmental Impact Statement instead of an Environmental Assessment for the environmental review, and concerns about plant safety and Holtecs perceived inexperience to operate the plant. The scoping comment period was announced on June 27, 2024, and is scheduled to close on July 29, 2024 (89 FR 53659).

List of Approved Spent Fuel Storage Casks: HI-STORM FW System, Certificate of Compliance No. 1032, Amendment No. 7; Direct Final Rule; 10 CFR Part 72 [NRC-2024-0096; RIN 3150-AL17]

On July 12, 2024, the NRC published a notice in the Federal Register (89 FR 57064) amending its spent fuel storage regulations by revising the Holtec International HI-STORM Flood/Wind Multipurpose Canister Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 7 to Certificate of Compliance No. 1032. Amendment No. 7 revises the certificate of compliance to add a new overpack, add new multipurpose canisters MPC-44 and MPC-37P, and add new fuel type 10x10J to approved content. Amendment No. 7 also incorporates other technical changes and several editorial changes. The companion proposed rule was also published in the Federal Register on July 12, 2024 (89 FR 57095). This direct final rule is effective September 9, 2024. Comments are requested by August 12, 2024.
