Office of Nuclear Reactor Regulation Items of Interest Week Ending April 5, 2024 Cooper Nuclear Station Notice of Enforcement Discretion On March 29, 2024, the staff verbally approved a Notice of Enforcement Discretion (NOED) request for Cooper Nuclear Station to address an issue discovered with their Turbine Stop Valve Limit Switches. The NOED extends their limiting condition for operation for 7 days, until April 5 to allow the licensee to submit an emergency license amendment request (LAR). This emergency LAR will request that the licensee be allowed to continue operation with the plant in its current condition until October 2024, so they can make the required modifications to the Turbine Stop Valve Limit Switches and Turbine Stop Valves.
Transfer of Project Management Responsibility On March 29,2024, the Office of Nuclear Reactor Regulation (NRR) transferred the project management responsibility for the GE-Hitachi Nuclear Test Reactor (NTR) to the Office of Nuclear Material Safety and Safeguards. GE-Hitachi Nuclear Energy Americas, LLC, elected to permanently cease operation of the NTR on December 21, 2023, and the staff subsequently issued license amendment No. 26, which amended the license and technical specifications for the NTR facility to reflect the cessation of operations (Agencywide Documents Access and Management System (ADAMS) Accession No. ML24031A622).
Information Notice 2024-02: Impact on Licensee Emergency Plans from Changes Made by Offsite Response Organizations to Alert and Notification Systems On April 1, 2024, the U.S. Nuclear Regulatory Commission (NRC) issued Information Notice 2024-02: Impact on Licensee Emergency Plans from Changes Made by Offsite Response Organizations to Alert and Notification Systems (ML23271A246). The purpose of the information notice is to inform the addressees of the importance of properly evaluating changes made by offsite response organizations for potential impacts to licensees emergency plans.
Pacific Gas and Electric at Diablo Canyon On April 2, 2024, Pacific Gas and Electric submitted two letters notifying the NRC that the licensee is revising the decommissioning schedule and plans to permanently cease power operations at Diablo Canyon, no later than October 31, 2029, for Unit 1 and October 31, 2030, for Unit 2, consistent with California Senate Bill No. 846. The licensees previous plan was to permanently cease power operations on the expiration date of the current operating licenses, that is, November 2, 2024, for Unit 1, and August 26, 2025, for Unit 2. The licensee is pursuing decommissioning and license renewal in parallel paths.
Advanced Reactor Construction Workshop On April 3, 2024, staff from NRR and Region II hosted a workshop with external stakeholders discussing the development of the advanced reactor construction oversight program. This workshop is a follow-on to the introductory sessions hosted on February 28 and March 20.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending April 5, 2024 Radioactive Source Security and Accountability: Discontinuation of rulemaking activity; 10 CFR Part 30, 40, & 70 [NRC-2022-0103; RIN 3150-AK83]
On April 2, 2024, the U.S. Nuclear Regulatory Commission (NRC) published a document in the Federal Register (89 FR 22636) to inform members of the public that the rulemaking activity, "Radioactive Source Security and Accountability," is being discontinued and to provide a brief discussion of the NRC's decision to discontinue the rulemaking. The rulemaking activity will appear in the completed actions section of the next edition of the Unified Agenda but will not appear in future editions. Effective April 2, 2024, the rulemaking activity is discontinued.
NRC Approved Exemption Request from Constellation Energy Generation to Allow Use of MPC-68M-CBS Canisters at the Dresden Nuclear Power Station Unit 2 and Unit 3 ISFSI On April 1, 2024, the NRC approved an exemption request from Constellation Energy Generation to allow them to use MPC-68M-CBS canisters at the Dresden Nuclear Power Station Unit 2 and Unit 3 Independent Spent Fuel Storage Installation (ISFSI). The licensee requested the exemption on February 23, 2024, because the canisters do not meet the terms, conditions, and specifications in the certificate of compliance for the HI-STORM 100 Cask System. This exemption would allow the ongoing storage of four MPC-68M-CBS canisters in the HI-STORM 100 Cask System, future loadings of one more in May 2024, and four others in March 2025 at the Dresden ISFSI. The exemption decision was published in the Federal Register (89 FR 22463). This is the first exemption for the use of MPC-68M-CBS canisters after the issue was identified, and similar exemptions are expected for those licensees using or seeking to use those canisters. The exemption was processed 17 days ahead of the licensees need date.
Issuance of Final Environmental Impact Statement for Turkey Point Nuclear Generating Unit Nos. 3 and 4 On April 5, 2024, NRC issued a final site-specific environmental impact statement (EIS)
NUREG-1437, Supplement 5a, Second Renewal, Site-Specific Environmental Impact Statement for License Renewal of Nuclear Plants Regarding Subsequent License Renewal for Turkey Point Nuclear Generating Unit Nos. 3 and 4, Final Report (89 FR 24045). This EIS is related to the subsequent renewal of Renewed Facility Operating License Nos. DPR-31 and DPR-41 for an additional 20 years of operation for Turkey Point Nuclear Generating Unit Nos. 3 and 4 (Turkey Point). Turkey Point is located in Homestead, Florida, approximately 25 miles south-southwest of Miami. Possible alternatives to the proposed action of subsequent license renewal for Turkey Point include the no-action alternative and reasonable replacement power and alternative cooling water system alternatives.
