Office of Nuclear Reactor Regulation Items of Interest Week Ending February 9, 2024 U.S. Nuclear Regulatory Commission (NRC) Issues Interim Staff Guidance (ISG), DANU-ISG-2023-01, Material Compatibility for non-Light-Water Reactors On February 6, 2024, the staff published a Federal Register Notice (FRN) issuing Interim Staff Guidance (ISG), DANU-ISG-2023-01, "Material Compatibility for non-Light-Water Reactors" (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23188A178). This ISG provides guidance used to assist the staff in determining whether an application for a non-light-water reactor facility that proposes to use materials allowed under American Society of Mechanical Engineers (ASME) Code Section III, Division 5, High Temperature Reactors, meets the minimum requirements for construction and operation in the area of material compatibility. Specifically, this ISG provides staff guidance on the review of material qualification and performance monitoring programs used to ensure that design requirements will continue to be met throughout the design life of the facility that are not addressed in ASME Code Section III Division 5.
The Palisades Restart Panel (PRP) Held its First In-Person Meeting During the week of January 29, 2024, the Palisades Restart Panel (PRP) (ML23297A053) held its first in-person meeting at the Region III offices. During the meeting the PRP discussed a number of topics including sequencing of licensing actions, Holtecs plans for reconstituting its quality assurance program, development of an inspection manual chapter (IMC), and communications. On Thursday, February 1, 2024, the PRP toured Palisades and met with Holtec management. Following the tour, the PRP attended a series of drop-ins with representatives from the Pokagon Band of Potawatomi and officials from local governments.
The PRP will tentatively hold a public meeting near Palisades on April 17, 2024.
The NRC Issued the Final Approved Version of the Safety Evaluation and Topical Report for Electric Power Research Institute (EPRI) Technical Report 3002018337, Use of Data Validation and Reconciliation Methods for Measurement Uncertainty Recapture, Revision 0-A On February 6, 2024, the U.S. Nuclear Regulatory Commission (NRC) staff issued (ML23299A054) the final approved version of the safety evaluation and topical report for EPRI Technical Report 3002018337, Use of Data Validation and Reconciliation Methods for Measurement Uncertainty Recapture, Revision 0-A (ML23285A308). The final report and safety evaluation presents a roadmap for future use of data validation and reconciliation (DVR) methods for measurement uncertainty recapture (MUR) that could be used by power plant licensees to support license amendment requests for power uprates. The ACRS review of the NRC staff evaluation is documented in their letter to the Commission on July 31, 2023 (ML23206A128).
Duke Energy Submits an Exemption Request Under the Risk-Informed Process for Evaluations (RIPE) for the Shearon Harris Nuclear Power Plant, Unit 1 On February 6, 2024, Duke Energy submitted an exemption request under the Risk-Informed Process for Evaluations (RIPE) for the Shearon Harris Nuclear Power Plant, Unit 1. Energy is requesting an exemption from the requirement in 10 CFR 50.55a(h)(2) for protection systems to meet the Institute of Electrical and Electronics Engineers (IEEE) 279-1971, Criteria for Protection Systems for Nuclear Power Generating Stations. Specifically, the exemption would remove the requirement for the Reactor Protection System cables that terminate within Turbine Control System Cabinet G to meet the IEEE 279-1971, Section 4.6 requirement that the cables be independent and physically separated. This is the second application submitted to the NRC using RIPE.
NRC Staff Issued a Readiness Assessment Letter to X-energy Related to X-energys Draft Preliminary Safety Assessment Report (PSAR) in Support of its Construction Permit Application for the Xe-100 Reactor On February 7, 2024, the NRC staff issued a readiness assessment letter (ML24011A071) to X-energy related to X-energys draft preliminary safety assessment report (PSAR) in support of its construction permit application for the Xe-100 reactor, which is proposed to be constructed at the Dow Chemical site in Seadrift, TX (Project Long Mott). The letter includes detailed observations identifying (1) areas where required information was not provided, (2) areas where additional information will be needed to support a regulatory finding, and (3) other observations that should be addressed or considered by X-energy to support the development of a quality application. In addition, the NRC staff identified two overarching areas that could substantially impact the ability of the NRC to accept and docket an application for review. These overarching areas are (1) the entire Chapter 2 of the PSAR was not included and (2) substantive portions of the draft PSAR were identified with placeholders that should be completed and validated in advance of the construction permit application.
NRC Staff Completed its Verification of the Approved Framatome Topical Report (TR)
ANP-10340P, Revision 0, Supplement 1P-A, Rev. 0, Incorporation of Chromia-Doped Fuel Properties in Framatome PWR Methods On February 5, 2024, NRC staff completed its verification (ML24019A088) of the approved Framatome topical report (TR) ANP-10340P, Revision 0, Supplement 1P-A, Rev. 0, Incorporation of Chromia-Doped Fuel Properties in Framatome PWR Methods (ML24011A253). Currently there are no specific licensing actions planned for use of this doped pellets TR. Doped pellets, an Accident Tolerant Fuel near-term technology, is discussed further in the ATF Project Plan (ML21243A298).

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending February 9, 2024 Unified Agenda of Federal Regulatory and Deregulatory Actions: Semiannual Regulatory Agenda; 10 CFR Chapter I [NRC-2023-0133]
On February 9, 2024, the U.S. Nuclear Regulatory Commission (NRC) published in the Federal Register (89 FR 9724) the semiannual regulatory agenda (the Agenda) in accordance with Public Law 96-354, The Regulatory Flexibility Act, and Executive Order 12866, Regulatory Planning and Review. The NRCs Agenda is a compilation of all rulemaking activities on which we have recently completed action or have proposed or are considering action. The comment period on the NRCs last Agenda (published on July 27, 2023), closed on August 28, 2023. The NRC did not receive any comments on its Spring 2023 Agenda. The NRC will request public comment on its Spring 2024 Agenda.
