(Historically was Continental Oil Co.)

The project began in the 1970s and is still ongoing today. Additionally, the site was transferred to the DOE for long-term custody in 1998.

Office of Nuclear Reactor Regulation Items of Interest Week Ending September 22, 2023 San Luis Obispo Mothers for Peace and Friends of the Earth Requested the Commission to Convene a Hearing Concerning Diablo Canyon Unit 1 On September 14, 2023, San Luis Obispo Mothers for Peace (SLOMFP) and Friends of the Earth (FoE) requested the Commission to convene a hearing concerning the U.S. Nuclear Regulatory Commissions (NRC) July 20, 2023, approval of a revision to the Diablo Canyon Unit 1 reactor vessel material surveillance capsule withdrawal schedule (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23199A312). SLOMFP and FoE also requested an emergency order requiring immediate shutdown of Unit 1 pending completion of tests and inspections of the pressure vessel, public disclosure of the results, a public hearing, and a determination by the Commission that Unit 1 can safely resume operation.

NRC Issues License Amendment Regarding Revision of Technical Specifications at Fermi Unit 2 On September 18, 2023, the NRC staff issued an Exigent License Amendment for Fermi Unit 2 to revise Technical Specification (TS) 3.7.2, Emergency Equipment Cooling Water/Emergency Equipment Service Water System and Ultimate Heat Sink (ML23243A885). DTE Electric Company submitted the amendment request under exigent circumstances to allow for a one-time extension of the Condition A Completion Time, from 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> to 7 days each, to perform online repairs to the Division I Mechanical Draft Cooling Tower A and C fan pedestals. The temporary one-time extension will expire at 23:59 on November 19, 2023.

NRC Staff Held a Public Observation Meeting with Industry and Members of the Public to Discuss the Reactor Oversight Process On September 20, 2023, the NRC staff hosted a public meeting related to the Reactor Oversight Process (ROP) to discuss: an overview of proposed recommendations to improve the NRCs Generic Issues Program (ML23256A001), how natural terrain features are credited with respect to vehicle barrier systems (ML23181A084), an update on Commercial Grade Dedication and Age-Related Degradation inspections, the path forward on the new Emergency Response Facilities and Equipment Needed for Emergency Response Performance Indicator, the status of NRC staff efforts to implement inspection guidance related to Probabilistic Risk Assessment configuration control (ML23257A145), a planned revision to Inspection Procedure 71152, Problem Identification and Resolution, and the current NRC staff position on a white paper submitted by NEI regarding AP1000 performance indicators (ML23136A607). Industry representatives presented another update on the draft NEI 99-02, Regulatory Assessment Performance Indicator Guideline, Revision 8 (ML23258A199), which they plan to submit for review in the near term. Attendees included the industrys Reactor Oversight Process Task Force, NextEra Energy, and members of the public. The next bi-monthly public meeting on ROP-related matters is tentatively scheduled for November 16, 2023.

NRC Issued a License Amendment for the University of California-Davis McClellan Nuclear Research Center Training, Research, Isotope, General Atomics Research Reactor On September 22, 2023, NRC staff issued a license amendment for the University of California-Davis (UCD) McClellan Nuclear Research Center (MNRC) Training, Research, Isotope, General Atomics research reactor (ML23263A976). The amendment revises TS 4.1.4, Fuel Parameters, and adds a specification to TS 5.3.1, Reactor Core, to provide the licensee operational flexibility to reconfigure the reactor core. UCD anticipates restart of the MNRC reactor the week of October 2, 2023.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending September 22, 2023 List of Approved Spent Fuel Storage Casks: NAC International, Inc., MAGNASTOR Storage System, Certificate of Compliance No. 1031, Renewal of Initial Certificate and Amendment Nos. 11 and 12 and Revisions to Amendment Nos. 0 Through 9; Direct Final Rule; Confirmation of Effective Date; 10 CFR Part 72 [NRC-2023-0085; RIN 3150-AK99]

On September 19, 2023, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (88 FR 64351) confirming the effective date of October 16, 2023, for the direct final rule that was published in the Federal Register on July 31, 2023 (88 FR 49267). This direct final rule amended its spent fuel storage regulations by revising the NAC International, Inc. MAGNASTOR Storage System listing within the List of approved spent fuel storage casks to include Amendment Nos. 11 and 12 and revisions to Amendment Nos. 0 through 9 to Certificate of Compliance No. 1031. The effective date of October 16, 2023, for the direct final rule published July 31, 2023, is confirmed.

List of Approved Spent Fuel Storage Casks: NAC Multi-Purpose Canister System, Certificate of Compliance No. 1025, Renewal of Initial Certificate and Amendment Nos. 1 Through 8; Direct Final Rule; Confirmation of Effective Date; 10 CFR Part 72 [NRC-2023-0080; RIN 3150-AK98]

On September 18, 2023, the NRC published a notice in the Federal Register (88 FR 63833) confirming the effective date of October 17, 2023, for the direct final rule that was published in the Federal Register on August 3, 2023 (88 FR 51209). This direct final rule amended the spent fuel storage regulations by revising the NAC Multi-Purpose Canister System listing within the List of approved spent fuel storage casks to renew, for 40 years, the initial certificate and Amendment Nos. 1 through 8 of Certificate of Compliance No. 1025. The renewal of the initial certificate and Amendment Nos. 1 through 8 revises the certificate of compliances conditions and technical specifications to address aging management activities related to the structures, systems, and components important to safety of the dry storage system to ensure that these will maintain their intended functions during the period of extended storage operations. The effective date of October 17, 2023, for the direct final rule published August 3, 2023, is confirmed.

Office of Administration Items of Interest Week Ending September 22, 2023 Forensic Accounting Services On September 18, 2023, contract number 31310023A0002 was awarded to Crowe LLP in South Bend, IN. The purpose of this contract is to procure support to the U.S. Nuclear Regulatory Commissions (NRC) Office of Inspector General (OIG) with forensic accounting during OIG-led audits and investigations. The period of performance is from September 11, 2023, through September 10, 2024, with four option periods. The total potential value of the contract can be up to $3,433,130.72.

Instruction Design and Learning Development Services On September 20, 2023, contract number 31310023C0023 was awarded to Avyance LLC in Reston, VA. The purpose of this contract is to obtain professional services for learning design and development to assist the NRC with learning modernization projects. The period of performance is from October 25, 2023, through October 24, 2024, with three option periods.

The total potential value of the contract can be up to $4,675,539.92.

Adobe Licenses and Support On September 19, 2023, contract number NNG15SD09B/31310023F0152 was awarded to Bahfed Corp. in Portland, OR. The purpose of this contract is to procure software licenses on a brand name only basis from an authorized reseller of Adobe Systems Incorporated products.

The period of performance is from November 17, 2023, through November 16, 2024, with no option periods. The total potential value of the contract can be up to $853,045.67.

NRC Childcare Subsidy Program On September 19, 2023, contract number 31310023C0026 was awarded to FEEA Childcare Services Inc. in Alexandria, VA. The purpose of this contract is to obtain support services from the contractor to assist the NRC in administering the NRCs Childcare Subsidy Program. The period of performance is from October 1, 2023, through September 30, 2024, with four option periods. The total potential value of the contract can be up to $816,437.04.

Office of Enforcement Items of Interest Week Ending September 22, 2023 DPO-2021-001 James A. FitzPatrick Nuclear Power Plant - Issuance of Amendment No.

338 RE: Alternative Source Term for Calculating Loss-of-Coolant Accident Dose Consequences The Differing Professional Opinion (DPO) raised concerns about the U.S. Nuclear Regulatory Commissions (NRCs) issuance of James A. FitzPatrick nuclear power plant operating license amendment No. 338, regarding use of the Alternative Source Term (AST) for calculating loss-of-coolant accident dose consequences. An ad-hoc review panel was formed and tasked by the NRC Differing Views Program to review the DPO. The review panel subsequently issued its report to the Director of the Office of Nuclear Reactor Regulation (NRR) on June 9, 2021. On November 17, 2021, the Director of NRR issued her DPO decision to the submitter.

The DPO submitter appealed this decision to the Executive Director for Operations (EDO) on January 7, 2022. After careful consideration of the issues raised in the appeal, the EDO issued his decision on the DPO appeal on August 25, 2023. The EDO directed NRR to: (1) take appropriate regulatory action to ensure FitzPatricks compliance with 10 CFR 50.67 and resolve the licensing clarity issues for the AST license amendment; and (2) develop an implementation plan for the other recommendations included in the DPO Appeal Panel Analysis Report, which include process and guidance updates and extent of condition evaluations, (see pages 255-256 of case file).

The EDO commended the DPO submitters willingness to raise concerns through the DPO process which is consistent with our organizational values of Openness and Commitment.
