Office of Nuclear Reactor Regulation Items of Interest Week Ending July 14, 2023 NRC Holds Public Meeting to Present Initial Plan for Updating Implementation Guidance Concerning Digital Instrumentation and Controls Common Cause Failures in Response to Commission Direction On July 11, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff held a public meeting (Agencywide Documents Access and Management System Accession No. ML23181A068) with external stakeholders to present the NRC staffs initial plan for updating implementation guidance concerning digital instrumentation and controls (I&C) common cause failures in response to SRM-SECY-22-00076 (ML23145A176). The NRC staffs initial plans include updating BTP 7-19, Guidance for Evaluation of Diversity and Defense-in-Depth in Digital Computer-Based Instrumentation and Control Systems to reflect the change in the Commissions policy on digital instrumentation common cause failures and controls. NRR Published a Federal Register Notice Seeking Public Comment on Four Revised Draft NUREGs that Provide Guidance for Subsequent License Renewal Applicants and Staff Reviewers On July 11, 2023, the Office of Nuclear Reactor Regulation published a Federal Register Notice (FRN) (88 FR 44160) seeking public comment on four revised NUREG drafts that provide guidance for subsequent license renewal applicants and staff reviewers. These are the Generic Aging Lessons Learned Report for Subsequent License Renewal (NUREG-2191) volumes 1 and 2, and the associated Standard Review Plan (NUREG-2192) and Technical Bases Document (NUREG-2221). The FRN publication starts a 60-day comment period, scheduled to close on September 11, 2023. The staff plans to conduct public meetings during the comment period to encourage public involvement and submission of comments. Oklo Announces that It Will Go Public Via Merger with Altc Acquisition Corp On July 11, 2023, Oklo announced that it will go public via merger with AltC Acquisition Corp., a special purpose acquisition company that was co-founded by OpenAI CEO Sam Altman, who is also the chairman of Oklos board. Oklo stated that the capital it raises by going public will go towards ramping up its supply chain and procurement processes and building a pilot scale production facility for the Aurora. The companies expect the deal to close in late 2023 or early 2024. Oklo is currently engaged in pre-application activities with the NRC staff in support of future licensing of its Aurora X reactor design and a fuel reprocessing facility. Industry representatives presented several topics including: Insights related to cybersecurity inspections and the more-than-minor criteria (ML23191A063), and an update on the upcoming revision to NEI 99-02 (ML23191A066). Attendees included the industrys ROP Task Force, NextEra Energy, and members of the public. The next bi-monthly public meeting on ROP-related matters is tentatively scheduled for September 20, 2023. NRC Staff Updated its Public Website on Modernizing the Regulatory Infrastructure for Digital Instrumentation and Controls The staff has updated the NRC public website on modernizing the regulatory infrastructure for digital I&C. The public website is available at this link: https://www.nrc.gov/reactors/digital/modernize.html. This update reflects the current state of digital I&C modernization and regulatory infrastructure improvement efforts. The staff has included a link to an interactive I&C regulatory infrastructure mapping presentation which should assist NRC staff, inspectors, applicants, licensees, and vendors identify the applicable regulations, guidance, and standards for various I&C technical areas. The staff also provided a link to recent digital I&C policy and guidance updates. Kairos Power Submits a Construction Permit Application for the Hermes 2 Test Reactor Facility On July 14, 2023, Kairos Power, LLC submitted a construction permit application for the Hermes 2 test reactor facility. The Hermes 2 facility would consist of two 35 MW test reactors, each with an intermediate heat transfer loop, a shared power conversion unit, and is proposed for the same site as Hermes in Oak Ridge, TN. The NRC staff plans to leverage the completed Hermes construction permit safety evaluation in its review of Hermes 2. Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending July 14, 2023 NMSS Staff Held Public Meeting on Fusion Rulemaking On July 12, 2023, the Office of Nuclear Material Safety and Safeguards staff held an information gathering public meeting for fusion energy systems rulemaking (Agencywide Documents Access and Management System Accession No. ML23177A076). The purpose of the meeting was to introduce the Commission's direction to commence a Title 10 of the Code of Federal Regulations Part 30 rulemaking with NUREG-1556 guidance, share some of the issues and challenges the staff anticipates, and listen to feedback from stakeholders. There was one U.S. Nuclear Regulatory Commission (NRC) staff presentation and four stakeholder presentations (ML23191A153). The meeting was well attended: over 150 individuals (e.g., NRC staff, fusion companies, Fusion Industry Association, academia, non-government organizations, Agreement States, U.S. Department of Energy).
