Office of Nuclear Reactor Regulation Items of Interest Week Ending June 16, 2023 NRC Finalized Communication Regarding Unexpected Loss of all Security System Power at Multiple Licensed Facilities On June 9, 2023, the U.S. Nuclear Regulatory Commission (NRC) finalized the Information Notice entitled, 2022-02, Revision 1: Operating Experience Related to the Unexpected Loss of Operating Security Power Due to Inadequate Testing and Maintenance, (Agencywide Documents Access and Management System Accession No. ML23129A013), to inform addressees about recent operating experience related to the unexpected loss of all security system power at multiple licensed facilities.
NRC Issued Safety Evaluation for Kairos Power LLCs Construction Permit Application On June 14, 2023, the staff issued its safety evaluation (SE) for Kairos Power LLCs (Kairos) construction permit application for its Hermes non-power test reactor to be located in Oak Ridge, TN. The SE was provided to Kairos for its information and was made public (ML23158A265). The SE is being issued ahead of the September 2023 public milestone and was completed within the published resource estimate.

Office of Nuclear Material Safety and Safeguards Items of Interest Week Ending June 16, 2023 Revision of Fee Schedules; Fee Recovery for Fiscal Year 2023: Final Rule; 10 CFR Parts 170 and 171 (RIN 3150-AK58; NRC-2021-0024)
On June 15, 2023, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (88 FR 39120) amending the licensing, inspection, special project, and annual fees charged to its applicants and licensees. These amendments are necessary to comply with the Nuclear Energy Innovation and Modernization Act, which requires the NRC to recover, to the maximum extent practicable, approximately 100 percent of its annual budget less certain amounts excluded from this fee-recovery requirement. This final rule is effective on August 14, 2023.
List of Approved Spent Fuel Storage Casks: TN Americas LLC, NUHOMS EOS Dry Spent Fuel Storage System, Certificate of Compliance No. 1042, Amendment No. 3; Direct Final Rule; Confirmation of Effective Date, 10 CFR Part 72 (NRC-2023-0050; RIN 3150-AK93 On June 15, 2023, the NRC published a notice in the Federal Register (88 FR 39119) confirming the effective date of July 17, 2023, for the direct final rule that was published in the Federal Register on May 2, 2023 (88 FR 27397). The direct final rule amended the TN Americas LLC, NUHOMS EOS Dry Spent Fuel Storage System listing within the List of approved spent fuel storage casks to include Amendment No. 3 to Certificate of Compliance No. 1042. The effective date of July 17, 2023, for the direct final rule published May 2, 2023, is confirmed.
