Items of Interest Week Ending APRIL 9, 2021 NRC Hosted Meeting on Global Nuclear Fuels ARMOR-Coated Cladding Fuel On April 6, 2021, the NRC staff held a closed meeting with Global Nuclear Fuel to discuss their status on the Abrasion Resistant More Oxidation Resistant (ARMOR)-coated cladding fuel (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21078A159). The topics discussed included an overview of their program, preliminary post-irradiation examination results, ongoing work, and next steps. The NRC staff plans to prepare a non-proprietary meeting summary.
NRC Hosted Meeting on the Preliminary Proposed Rule Language for 10 CFR Part 53 On April 8, 2021, the NRC staff held a public meeting to provide an opportunity for external stakeholders and the NRC staff to exchange information on the NRCs development of Title 10 of the Code of Federal Regulations (10 CFR) Part 53 preliminary proposed rule language for advanced nuclear reactors. The NRC staff and stakeholders discussed changes to previously released preliminary proposed rule language for Subparts B, Technology-Inclusive Safety Requirements, and C, Design and Analysis Requirements, and new preliminary proposed rule language for Subpart E, Construction and Manufacturing. The NRC staff also discussed the NRCs white paper entitled, Risk-Informed and Performance-Based Human-System Considerations for Advanced Reactors, (ADAMS Accession No. ML21069A003), and the development of key guidance that will support the 10 CFR Part 53 rulemaking. More than 150 stakeholders attended the meeting, including representatives from the Nuclear Energy Institute, U.S. Nuclear Industry Council, Union of Concerned Scientists, Southern Nuclear, and advanced reactor developers. Stakeholders provided varying perspectives, which the NRC staff will consider as it iterates on the preliminary proposed rule language. The NRC staff plans to release the preliminary proposed rule language related to 10 CFR 53.20, Definitions, and portions of Subpart F, Requirements for Operation, to support a public meeting on May 6, 2021.
Staff Approved Licensing Request for Regulatory Relief Related to the COVID-19 Public Health Emergency The NRC staff has reviewed and approved several licensing requests seeking temporary flexibilities to maintain the safe and secure operation of the U.S. nuclear fleet during the pandemic. A summary of the approved licensing action provided during this reporting period is summarized below. A complete list of licensing actions approved by the NRC in response to the COVID-19 public health emergency is available on the NRC public website at https://www.nrc.gov/about-nrc/covid-19/reactors/licensing-actions.html.

Items of Interest Week Ending APRIL 9, 2021 Radio Broadcast Regarding United Nuclear Corporations Mill Site Amendment Request Aired On April 7-9, 2021, a series of three radio broadcasts prepared by the NRC staff aired on KTNN (Navajo Nation radio). The broadcasts were a series of three pre-recorded presentations regarding the United Nuclear Corporation (UNC) Mill Site License Amendment Request. UNC is proposing to move waste from the nearby Northeast Church Rock mine and place that waste for permanent disposal at the mill site. In the first broadcast (April 7), the NRC staff discussed its findings on the Draft Environmental Impact Statement (DEIS). The second broadcast (April
- 8) discussed the staffs Safety Evaluation Report findings, and the last broadcast (April 9) included answers to questions heard from the community during the DEIS comment period.
Staff prepared the broadcasts in an effort to reach more of the local community given pandemic-related restrictions (for in-person meetings) and the communitys limited access to phone and internet. This effort was intended to facilitate public comments on the staffs DEIS; the public comment period ends on May 27. NMSS Staff Held a Public Webinar on Preliminary Proposed Rule Language for Part 53 On April 8, 2021, the staff held a public webinar to provide an opportunity for external stakeholders and the NRC staff to exchange information on the NRCs development of the Part 53 preliminary proposed rule language for advanced nuclear reactors. The NRC staff and stakeholders discussed changes to previously released preliminary proposed rule language for Subparts B, Technology-Inclusive Safety Requirements, and C, Design and Analysis Requirements, and new preliminary proposed rule language for Subpart E, Construction and Manufacturing. The staff also discussed the NRC White Paper Risk-Informed and Performance-Based Human-System Considerations for Advanced Reactors, dated March 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21069A003), and the development of key guidance that will support the Part 53 rulemaking.
Over 150 stakeholders attended the meeting, including representatives from NEI, USNIC, UCS, SNC, and advanced reactor developers. Stakeholders provided varying perspectives which the staff will consider as it refines the preliminary proposed rule language. The next steps will be to release preliminary proposed rule language related to § 53.20, Definitions, and portions of Subpart F, Requirements for Operation, to support a public meeting on May 6.

Advance Tribal Notification of Certain Radioactive Material Shipments; Petition for Rulemaking; Notice of Docketing; Request for Comment; 10 CFR Part 37 (PRM-37-2; NRC-2021-0051)
On April 9, 2021, the NRC published a notice of docketing and request for comment in the Federal Register (86 FR 18477) for a petition for rulemaking from Richard Arnold and Ron Johnson on behalf of the Tribal Radioactive Materials Transportation Committee, dated December 4, 2020. The petitioners requested that the NRC revise its regulations to ensure consistency regarding advance Tribal notification of certain radioactive material shipments with similar regulations for State notification. The petition was docketed by the NRC on February 11, 2021, and has been assigned Docket No. PRM-37-2. The NRC is examining the issues raised in PRM-37-2 to determine whether they should be considered in rulemaking. Comments are requested by June 23, 2021.
