Items of Interest Week Ending APRIL 10, 2020 Staff Completes Safety Review of the General Electric-Hitachi ABWR Design Certification Renewal Application On March 30, 2020, the Office of Nuclear Reactor Regulation staff completed its technical review of the General Electric-Hitachi (GEH) advanced boiling-water reactor (ABWR) design certification (DC) renewal application. GEH submitted the ABWR DC renewal application on December 7, 2010, and this is the first DC renewal that has been completed under 10 CFR Part

Staff Hosts Public Webinar on Regulatory Improvements to Support the Licensing of Advanced Reactors On April 2, 2020, the U.S. Nuclear Regulatory Commission (NRC) staff held a public webinar with over 200 stakeholders on regulatory improvements to support the licensing of advanced reactors. Topics included environmental reviews, digital instrumentation and control, fuel cycle, policy issues, financial qualification, and insurance and liability. This meeting was in support of Strategy 3 (regulatory framework) and Strategy 5 (resolution of policy issues) of the advanced reactor Implementation Action Plans.

Staff Approves First Part 26 Exemption Request Related to COVID-19 On April 2, 2020, the staff received the first Part 26 exemption request related to COVID-19 that was submitted in the accordance with the process outlined in the NRCs March 28, 2020, letter.

The submittal was for the Limerick Generating Station Units 1 and 2, exemption from select requirements of Title 10 of the Code of Federal Regulations Part 26 (Agencywide Document Access and Management System (ADAMS) Accession No. ML20093M206). The approval letter can be found at ADAMS Accession No. ML20093M820.

Items of Interest Week Ending APRIL 10, 2020 Transfer of Very Low-Level Waste to Exempt Persons for Disposal: Proposed Interpretive Rule; Extension of Comment Period; Chapter I of Title 10 of the Code of Federal Regulations (10 CFR) (NRC-2020-0065)

On April 9, 2020, the U.S. Nuclear Regulatory Commission (NRC) published a notice in the Federal Register (85 FR 19907) extending the comment period for a notice published on March 6, 2020 (85 FR 13076), which solicited comments on a proposed interpretation of its low-level radioactive waste disposal regulations. The public comment period was originally scheduled to close on April 20, 2020. Due to the impacts of the COVID-19 pandemic across the nation, the NRC has decided to extend the public comment period. Now, comments should be filed no later than July 20, 2020.

Fire Protection Compensatory Measures: Petition for Rulemaking; Denial; 10 CFR Part 50; (PRM-50-115; NRC-2017-0132)

On April 8, 2020, the NRC published a notice in the Federal Register (85 FR 19701) denying a petition for rulemaking (PRM)-50-115, dated May 1, 2017, submitted by David Lochbaum and Paul Gunter (the petitioners) on behalf of the Union of Concerned Scientists and Beyond Nuclear, respectively. The petitioners requested that the NRC issue regulations that establish acceptable conditions for the use of compensatory measures (e.g., fire watches, surveillance cameras) during periods when fire protection regulations are not met, as well as define the maximum duration that compensatory measures may be relied upon. The NRC is denying the petition because the petitioners did not present sufficient new information to warrant the requested changes in light of the NRCs relevant past decisions and current policies. Therefore, the NRC is denying PRM-50-115. The docket for PRM-50-115 was closed on April 8, 2020.
