Items of Interest Week Ending MARCH 20, 2020 Individual Monitoring Devices: Direct Final Rule; Parts 34, 36, and 39 of Title 10 of the Code of Federal Regulations (10 CFR) [Regulatory Information Number (RIN) 3150-AK29; NRC-2019-0031]
On March 18, 2020, the U.S. Nuclear Regulatory Commission (NRC) published a document in the Federal Register (85 FR 15347) amending its regulations to authorize the use of modern individual monitoring devices in industrial radiographic, irradiator, and well logging operations.
These amendments will align personnel dosimetry requirements in these areas with the requirements for all other NRC licensees. This direct final rule addresses an issue raised in a petition for rulemaking and will affect NRC and Agreement State licensees. The companion proposed rule was also published on March 18, 2020 (85 FR 15395). The NRC also is issuing supplemental guidance for use and comment with this direct final rule. This direct final rule and supplemental guidance are effective June 16, 2020.
Approval of American Society of Mechanical Engineers Code Cases: Final Rule; 10 CFR Part 50; (RIN-3150-AJ93; NRC-2017-0024)
On March 16, 2020, the NRC published a document in the Federal Register (85 FR 14736) amending its regulations to incorporate by reference the latest revisions of three regulatory guides approving new, revised, and reaffirmed Code Cases published by the American Society of Mechanical Engineers (ASME). This action allows licensees and applicants to use the Code Cases listed in these regulatory guides as voluntary alternatives to engineering standards for the construction, inservice inspection, and inservice testing of nuclear power plant components.
These engineering standards are set forth in the ASMEs Boiler and Pressure Vessel Codes and ASMEs Operation and Maintenance Codes, which are currently incorporated by reference into the NRCs regulations. Further, this final rule announces the availability of a related regulatory guide, not incorporated by reference into the NRCs regulations, that lists Code Cases that the NRC has not approved for use. This final rule is effective on April 15, 2020.
Separately, the NRC is in the process of preparing the final rule for the ASME 2015-2017 Code Editions Incorporation by Reference. That final rule updates the current NRC regulations to incorporate by reference more recent code editions published by the ASME. The NRC plans to publish this final rule in May 2020.
