December 17, 2010 ENCLOSURE A Office of Nuclear Reactor Regulation (NRR)

Items of Interest Week Ending December 17, 2010 Grand Gulf Unit 1 Extended Power Uprate Acceptance By application dated September 8, 2010, the licensee requested a 13% extended power uprate (EPU) for Grand Gulf Unit 1. By letter dated November 9, 2010, the staff identified several information needs in order to accept the application, and by letters dated November 18 and 23, 2010, the licensee provided the supplemental information. By letter dated December 9, 2010, the staff informed the licensee that the application provides technical information in sufficient detail to enable the staff to proceed with the detailed technical review. The application requests NRC approval in 14 months from the application date with implementation upon startup from the spring 2012 refueling outage. NRCs standard review time for an EPU is 12 months after NRCs acceptance of the application.

Pre-licensing Meeting with Pacific Gas and Electric Company (PG&E)

On December 9, 2010, representatives of PG&E and the staff met to discuss the licensees plans to submit a license amendment to incorporate management of new geotechnical seismic information into its design and licensing basis for Diablo Canyon Power Plant, Units 1 and 2.

Briefing to the Advisory Committee on Reactor Safeguards On December 13 and 14, 2010, the staff provided briefings to the Advisory Committee on Reactor Safeguards Subcommittee regarding licensees transition to National Fire Protection Association (NFPA) Standard 805. The topics discussed related to the Commission request in SRM-M100609B to conduct a review of the current state of licensees efforts to transition to NFPA 805.

Issuance of Crystal River Unit 3 Nuclear Generating Plant License Renewal Safety Evaluation Report with Open Items On December 14, 2010, the staff issued the Safety Evaluation Report (SER) with Open Items related to the Crystal River Unit 3 Nuclear Generating Plant (CR-3) license renewal application.

By letter dated December 16, 2008, Florida Power Corporation submitted an application requesting the extension of the CR-3 operating license for an additional 20 years. The SER has nine open items (e.g., aging management of the containment given recent operating experience and event-driven inspection of potentially submerged cables) and two confirmatory items (consistency of the Compressed Air Monitoring Program and the leak-before-break analysis of cast austenitic stainless steel piping). The staff is scheduled to meet with the Advisory Committee on Reactor Safeguards Subcommittee on January 12, 2011, to discuss the SER with Open Items.

Issuance of the Renewed Operating License for Duane Arnold Energy Center On December 16, 2010, the operating license for Duane Arnold Energy Center was renewed authorizing operation for an additional 20 years beyond the original license expiration date. The

The staff completed the review as documented in the SER, NUREG-1955, published November 2010 and Supplement 42 to the Generic Environmental Impact Statement for License Renewal of Nuclear Plants, NUREG-1437, published in October 2010. The issuance of the Duane Arnold Energy Center renewed license brings the total number of renewals to 61 reactor units.

Fire Protection Meeting on NFPA 805 Frequently Asked Questions (FAQs)

On December 16, 2010, the staff held a Category 2 public meeting with the Nuclear Energy Institute NFPA Standard 805 Task Force, other stakeholders, and the public, to discuss the FAQs related to licensees adoption of NFPA 805. The staff began holding these monthly public meetings in July 2006 and expects to continue holding them at least throughout the transition period for the pilot plants adopting NFPA 805.

Issued Safety Evaluation Template for NFPA 805 License Amendment Requests The staff publicly has issued a Safety Evaluation template that will be used to expedite the review of future NFPA 805 license amendment requests. The template (ADAMS Accession No. ML102170233) incorporates the lessons learned from the Shearon Harris Nuclear Plant pilot application as well as stakeholders comments received through a series of six public meetings that took place throughout CY 2010. This template does not represent additional requirements or guidance for plants transitioning to NFPA 805, nor does it represent new technical positions of the NRC staff.

Items of Interest Week Ending December 17, 2010 Final Safety Evaluation Report for the Mixed Oxide Fuel Fabrication Facility On December 13, 2010, NMSS approved the issuance of the Official Use Only (OUO) version of the final Safety Evaluation Report (SER) for the license application by Shaw AREVA MOX Services, LLC, to possess and use radioactive material at the Mixed-Oxide Fuel Fabrication Facility at the U.S. Department of Energys Savannah River Site near Aiken, South Carolina.

The SER was reviewed and approved by the Advisory Committee on Reactor Safeguards. The OUO version contains sensitive-security related information. Staff is preparing a redacted SER, which will be published as a NUREG and publically available.

Items of Interest Week Ending December 17, 2010 Publication of Regulatory Guide (RG) 3.12, General Design Guide for Ventilation Systems of Plutonium Processing and Fuel Fabrication Plants On December 17, 2010, RES staff published RG 3.12, General Design Guide for Ventilation Systems of Plutonium Processing and Fuel Fabrication Plants. This guide describes a method that the NRC staff considers acceptable for use in complying with Title 10, Section 70.23(a)(3) of the Code of Federal Regulations (10 CFR 70.23(a)(3)), and 10 CFR 70.23(a)(4) on the design of ventilation systems for plutonium processing and fuel fabrication plants. RG 3.12 is available on the NRC Web site at http://www.nrc.gov/reading-rm/doc-collections/reg-guides/fuels-materials/rg/.

RES Publication of RG 5.80, Pressure-Sensitive and Tamper-Indicating Device Seals for Material Control and Accounting of Special Nuclear Material On December 17, 2010, RES staff published RG 5.80. This RG replaces the existing RG 5.10, Selection and Use of Pressure-Sensitive Seals on Containers for Onsite Storage of Special Nuclear Material, issued July 1973 and the existing RG 5.15, Tamper-Indicating Seals for the Protection and Control of Special Nuclear Material, issued March 1997. This RG describes a number of recently improved tamper-indicating devices (TIDs) and pressure-sensitive seals developed primarily in response to commercial interests outside the nuclear industry. Among other things, it distinguishes between genuine and nongenuine manufactured seals, stresses serial number identification, and incorporates recommendations for ensuring that TIDs are properly applied. Items of Interest Week Ending December 17, 2010 Contract for High-Burn-up Mixed-Oxide Fuel (HBU-MOX) Source Term Peer Review On December 10, 2010, a competitive Federal Supply Schedules delivery order (NRC-HQ-11-F-04-0001) was awarded to Energy Research, Inc., a small business located in Rockville, Maryland, to organize and conduct a peer review of the recommended source term for reactors with HBU-MOX and to provide an independent assessment of the suitability of this source term for containment equipment qualification and siting dose calculations. The period of performance is one year from January 1, 2011 to December 31, 2011, with no options. The total price is $171,562.12.

Domestic Licensing of Production and Utilization Facilities; Updates to Incorporation by Reference of Regulatory Guides; Correction (NRC-2009-0014, RIN 3150-AI37)

On December 10, 2010 (75 FR 76923), NRC published a correction to a final rule that was published in the Federal Register on October 5, 2010 (75 FR 61321). The final rule amended the NRCs regulations to incorporate by reference the latest revisions of two previously incorporated regulatory guides. This document is necessary to add a line of regulatory text that was inadvertently omitted from the final rule. The correction was effective on December 10, 2010, and is applicable beginning November 4, 2010, the date the original rule became effective.
