June 8, 2012 Mr. John Ventosa, Site Vice President RI-2010-A-0104 Entergy Nuclear Operations, Inc.

Subject:

NRC Office of Investigations Case No. 1-2011-013

Dear Mr. Ventosa:

The Region I Field Office, NRC Office of Investigations (OI), initiated an investigation (Case No.

1-2011-013) on January 5, 2011, to determine whether two security officers (SOs) working at the Indian Point Energy Center willfully failed to perform fire watches and willfully falsified fire watch checklists. The NRC determined that as part of normal reviews, Entergy staff identified two instances in December 2011 where SOs did not complete a portion of an hourly fire watch tour. The problems were documented in Entergys Corrective Action Program and corrective actions were completed. Based upon the NRCs review of all of the evidence developed during our investigation, the NRC did not substantiate that the SOs willfully failed to perform fire watches or willfully falsified fire watch checklists. The NRC concluded the two incomplete fire watch tours constituted minor violations of NRC requirements and no further action by the NRC is planned.

Please note that final NRC investigation documents, such as the OI report described above, may be made available to the public under the Freedom of Information Act (FOIA) subject to redaction of information appropriate under the FOIA. Requests under the FOIA should be made in accordance with 10 CFR 9.23, Requests for Records, a copy of which is enclosed for your information.

In accordance with 10 CFR 2.390 of the NRC's "Rules of Practice," a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
