Response
Type 1
Upon our receipt of your request on October 22, 2024, we tasked the Offices of Nuclear Reactor Regulation (NRR), Nuclear Material Safety and Safeguards (NMSS) (which has responsibility for the Agreement State Program), and Region I (which has regulatory responsibility for the state of Maryland) to search for any responsive records.
Region I and NMSS staff did not locate any records responsive to the FOIA request.
NRR staff did not locate any responsive records for items 1, 2, 3, 5, and 6.
In item 2, you requested documents detailing the current licensing and development requirements for new nuclear power facilities in Maryland, including:
o State-specific requirements; o Federal requirements applicable to Maryland; and o Any correspondence between the NRC and Maryland state agencies regarding nuclear power development since 2020 NRR staff suggested that, if you have not already done so, you reach out to Maryland state officials for any requirements imposed at the state level. With respect to Federal requirements, the NRC's regulations may be found in Title 10 of the Code of Federal Regulations, https://www.nrc.gov/reading-rm/doc-collections/cfr/index.html. Maryland is an Agreement State, so you may also wish to refer to https://www.nrc.gov/agreement-states/maryland.html, for additional information and points of contact for Maryland (which may also address some of the information you seek in item 3).
None of the offices located correspondence between the NRC and Maryland state agencies regarding nuclear power development since 2020.
In item 4 you are seeking documentation concerning the Three Mile Island reopening project; responsive records are already publicly available in the NRC's official recordkeeping repository, Agencywide Documents Access and Management System [ADAMS] at the following links:
