No: 23-063 October 3, 2023 CONTACT: Scott Burnell, 301-415-8200 NRC Announces Hearing Opportunity on Carbon Free Power Projects Limited Work Authorization Application The Nuclear Regulatory Commission announced the opportunity to request a hearing on an application from the Carbon Free Power Project for early construction work at the site where it plans to build a proposed nuclear power plant. The CFPPs limited work authorization application, filed on July 31, requests NRC approval to begin preparing a site at the Idaho National Laboratory complex, near Idaho Falls, Idaho.

The CFPP, created by the Utah Associated Municipal Power Systems group, anticipates constructing on the site a nuclear power plant containing six small modular reactors based on the NuScale design, which is currently under NRC review. The NRC accepted the limited work authorization application for review, or docketing, in September. The application requests permission to conduct activities such as site excavation and subgrade rock remediation.

The CFPP must submit a separate application for a combined license that would allow construction and eventual operation of a plant.

The hearing opportunity was published in a Federal Register notice today. Anyone whose interest may be affected by the proposed early construction work can file a petition to intervene by December 4. More information on the hearing process is available on the NRC website.

Comments on the limited work authorization request can be submitted online at www.regulations.gov (under Docket ID NRC-2023-0143) through Nov. 13.
