Proposed Scope of Work and Budget for 2024 - Revision 1 Cimarron Environmental Response Trust, Consent Decree Case# 09-10156, NRC License No. SNM-0928

Dear Mr. Lux and Mr. Hesemann:

Thank you for the Proposed Scope of Work and Budget, as revised January 30, 2024. As noted, this is intended to cover costs for Calendar Year 2024 and the first three months of 2025. Based on the task-by-task breakdown of costs between State and Federal Accounts of the trust stated in the Budget, the State account's share is 5.2% of the $5.2 Million Total budget. In the summary spreadsheet in Attachment 2, there may be a typographical error in the "Lump Sum" figure in Budget Task 5, but it is not reflected in the "Total Cost" for the task or in the approved Budget.

DEQ, as beneficiary of the Trust, has no objection to the proposed Scope and Budget, provided the Nuclear Regulatory Commission also approves.

DEQ looks forward to timely approval of the Budget, and progress towards beginning actual remediation at the site.
