The inspection was an examination of the activities conducted under your license as they relate to radiation safety and to compliance with the Nuclear Regulatory Commission (NRC) rules and regulations and the conditions of your license. The inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observations by the inspector. The inspection findings are as follows:

1. Based on the inspection findings, no violations were identified.
2. Previous violation(s) closed.
3. During this inspection, certain of your activities, as described below and/or attached, were in violation of NRC requirements, and were assessed at Severity Level IV, in accordance with the NRC Enforcement Policy.

B. The following violation(s) is/are being cited in accordance with NRC Enforcement Policy. This form is a NOTICE OF VIOLATION, which may be subject to posting in accordance with 10 CFR 19.11.

(Violations and Corrective Actions)

Title 10 CFR 31.5(c)(8)(i) requires, in part, that any person who possesses or uses generally licensed byproduct material in a device shall properly dispose of the device containing byproduct material.

Contrary to the above, in early November 2022, Helmut, LLC failed to properly dispose of a device containing generally licensed byproduct material. Specifically, Helmut, LLC disposed of a static eliminator, used in a Statement of Corrective Actions I hereby state that, within 30 days, the actions described by me to the Inspector will be taken to correct the violations identified. This statement of corrective actions is made in accordance with the requirements of 10 CFR 2.201 (corrective steps already taken, corrective steps which will be taken, date when full compliance will be achieved). I understand that no further written response to NRC will be required, unless specifically requested.

A. The violation(s), specifically described to you by the inspector as non-cited violations, are not being cited because they were self-identified, non-repetitive, corrective action was or is being taken, and the remaining criteria in the NRC Enforcement Policy were satisfied.

Page 2 of 2 compressed air nozzle that contained polonium-210, into the regular municipal trash during a relocation move of a Helmut, LLC office to a new facility.

Upon discovery Helmut, LLC reported the lost material to the NRC and submitted a written report regarding the loss within 30 days, which can be found at the NRC's Agencywide Documents Access and Management System (ADAMS) Accession No. ML23236A596. To prevent recurrence of this issue, Helmut LLC provided general awareness training to their staff who use the air nozzle, and designated a manager to be responsible for oversight of the static eliminator.

NRC Inspection Report for HELMUT, LLC Hi Clayton, Attached is an NRC inspection report in response to the loss of material and Event Report (EN56663)

This is the simplest report the NRC issues, and it identifies one violation of NRC requirements with no response required and no civil penalty. My branch chief will need to sign it after you, before it becomes official. She might want a more formal report, in which case well throw this report out and re-do it. Either way, another written response shouldnt be needed from HELMUT and there wont be a civil penalty.

Please review the report and the corrective actions as described for accuracy, then sign it if the description is correct and email it back to us. Let me know if you have any questions about the process.
