Greenaction 2.206 submittal re: Tetra Tech HPNS clean-up September 11, 2023 Mr. Castleman, The Nuclear Regulatory Commission (NRC) received your petition request pursuant to Section 2.206 of Title 10 of the Code of Federal Regulations (10 CFR 2.206) dated September 11, 2023, and initiated the screening process in accordance with Section II.A.2(d) of NRC Management Directive (MD) 8.11, Review Process for 10 CFR 2.206 Petitions (NRCs Agencywide Documents Access and Management System (ADAMS) Accession No. ML18296A043). In your original petition, dated June 28, 2017, as supplemented, you requested that the NRC revoke Tetra Tech EC, Inc.s (TtECs) Material License No. 29-31396-01 due to its fraudulent activities at the Hunters Point Naval Shipyard (HPNS). You stated that your September 11, 2023, request added new and significant facts not previously known to the NRC about the nature, scope, and impact of the TtEC radiological fraud and compromised quality assurance and quality control in the cleanup at HPNS.
The NRC staff has screened your September 11, 2023, request out of the 2.206 Petition Process consistent with MD 8.11 Section II.A.2(d)(ii), General Assertions and Duplicative Requests for Action under 10 CFR 2.206. The NRC has concluded that your request, which incorporates your previous petition and four supplements by reference, is duplicative of your June 28, 2017, 2.206 petition, as supplemented. MD 8.11 explains that the staff will not addressduplicative requests for action under the 2.206 petition process. Therefore, your petition will not be entered into the 2.206 process.
Your September 11, 2023, request offers additional information to demonstrate the extent of fraud committed by Tetra Tech EC, Inc. (TtEC) at HPNS. However, the request does not contain significant new information that would cause the staff to reconsider its previous determinations regarding this matter. As described in the Closure Letter dated June 28, 2023 (ML19101A254),
the NRC has evaluated numerous allegations of wrongdoing at HPNS consistent with the NRCs Allegation Program, and has conducted multiple inspections and investigations, including the Office of Investigation (OI) acting as a lead agency in the Department of Justice (DOJ) investigation of criminal wrongdoing. The Closure Letter also stated that if the NRC obtains significant new information from the DOJ civil suit proceedings, NRC staff will reassess previous TtEC enforcement actions. Because your September 11, 2023, request provides additional details about the extent and scope of fraudulent activities performed by TtEC, for which the NRC has already taken numerous actions, the staff has determined that it is a duplicative request for action.
