ACCEPTANCE OF GENERAL ELECTRIC COMPANY APPLICATION FOR ORDER CONSENTING TO INDIRECT TRANSFER OF CONTROL OF LICENSES - ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2023-LLM-0003

Dear Michelle Catts:

By letter dated May 30, 2023 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML23152A116), General Electric Company (GE), GE-Hitachi Nuclear Energy Americas, LLC (GEHA), and Global Nuclear Fuel-Americas, LLC (GNF-A) (together, applicants) submitted an application requesting consent from the U.S. Nuclear Regulatory Commission (NRC) for the indirect transfer of control of reactor, materials, and export licenses, held by GEHA and GNF-A, and notification regarding other approvals.

The NRC staff performed an acceptance review of your application to determine if it contained sufficient technical information in scope and depth for proceeding with its detailed technical review. Based on this review, the NRC staff determined that the application contains sufficient information for proceeding with its detailed technical review. The enclosure to this letter, however, provides observations on information that the NRC staff could potentially request later.

These observations are provided to allow the applicants to start working early on these items.

Please note that these observations are not the result of a detailed technical review and that responses are not currently required for the NRC staff to begin its detailed technical review of the application. You may supplement your application, if you so desire, before the NRC staff formally makes any requests for additional information (RAI).

In the submittal, the applicants requested that the NRC response by November 1, 2023.

However, based on our projection of current work priorities, the NRC staff workloads, and review schedules, we anticipate issuing our final response by mid-November 2023. The review schedule includes the issuance of an RAI, if needed, by early August 2023, and receiving your responses within 20 days from the RAIs issuance date.
