OF MAY 9, 2023, CLOSED MEETING WITH FRAMATOME INC. AND THE U.S. NUCLEAR REGULATORY COMMISSION FOR PLANNED WHITE PAPER ON FUEL FRAGMENTATION, RELOCATION AND DISPERSAL (EPID L-2023-LRO-0033)
On May 9, 2023, the U.S. Nuclear Regulatory Commission (NRC) staff held a closed hybrid meeting via Microsoft Teams with representatives from Framatome Inc. (Framatome). The purpose of the meeting was for the NRC staff and Framatome representatives to discuss a planned white paper on fuel fragmentation, relocation, and dispersal (FFRD). The meeting notice is available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML23117A378.
At the beginning of the meeting Framatome representatives provided an overview of their planned FFRD white paper, including topics and feedback that would be requested. Framatome discussed the regulatory uncertainty associated with FFRD and plans to use the white paper process as a way to provide some level of certainty with respect to modern, risk-informed regulatory framework. Framatome also provided information on their near-term plans pertaining to the planned white paper and a higher burnup topical report (TR) submittals. The NRC staff provided a high-level discussion on the approach that can be used for submittals as described in office instruction, COM-204, Informal Interfacing with and Handling Documents from Owners Groups, Vendors, Nuclear Energy Institute, Licensees, and Other External Stakeholders. For the planned white paper, the NRC staff emphasized that there are no regulatory findings or finality associated with the feedback and that the review process will be determined at the time of submittal based on the type of feedback that Framatome requests.

The NRC staff also discussed the pre-application process, benefits, and what to expect from the current white paper process that is used extensively in the Division of Advanced Reactors and Non-power Production and Utilization Facilities. The NRC staff also emphasized the importance and benefits of a pre-submittal meeting to discuss details of the planned white paper since this meeting was primarily focused on the review process. Additionally, the NRC staff provided the TerraPower, Regulatory Gap Analysis Report (ADAMS Accession No. ML22266A285) submittal and NRC staffs technical assessment observation (ADAMS Accession No. ML23080A086) as an example of a recently approved white paper.
Framatome provided responses to the NRC staff questions on a submittal date, review expectations, desired outcome, requested NRC staffs feedback, and associated TR. The NRC staff and Framatome representatives also discussed how regulations and guidance may or may not be used for the planned submittal. Framatome reiterated that one of the goals for submitting a white paper on FFRD is to establish some level of regulatory certainty. At the end of the meeting the NRC staff emphasized the importance of having an additional pre-submittal meeting before submitting the FFRD white paper.
