ACCEPTANCE REVIEW FOR NUCLEAR ENERGY INSITUTE DOCUMENT NEI 16-03, REVISION 1, GUIDANCE FOR MONITORING OF FIXED NEUTRON ABSORBERS IN SPENT FUEL POOLS (EPID L-2022-NTR-0002)

Dear Mr. McCullum:

By letter dated August 19,2022, as supplemented by letters dated October 12 and December 15, 2022 (Agencywide Documents Access and Management System (ADAMS)

Accession Nos. ML22231B041, ML22298A281, and ML22349A656, respectively), the Nuclear Energy Institute (NEI) submitted guidance document NEI 16-03, Revision 1, Guidance for Monitoring of Fixed Neutron Absorbers in Spent Fuel Pools, on behalf of its members for U.S. Nuclear Regulatory Commission (NRC) review and endorsement. NEI 16-03, Revision 1, includes Electric Power Research Institute (EPRI) Technical Report 3002018497, Industrywide Learning Aging Management Program (i-LAMP): Global Neutron Absorber Material Monitoring Program for Spent Fuel Pools, dated August 2022, as an alternative monitoring approach.

In response to NRCs non-acceptance letter dated December 2, 2022 (ADAMS Accession No. ML22301A179), NEI provided its response via supplemental letter dated December 15, 2022.

The purpose of this letter is to provide the results of the NRC staffs acceptance review of the NEI submittals. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review.

The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements in the guidance document.

The NRC staff has reviewed your application and concluded that it does provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed guidance document in terms of regulatory requirements and the protection of public health and safety and the environment. Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. You will be advised of any further information needed to support the NRC staffs detailed review by separate correspondence.

Based on the information provided in your submittal, the NRC staff has estimated that this guidance document review will take approximately 1,060 hours6.944444e-4 days <br />0.0167 hours <br />9.920635e-5 weeks <br />2.283e-5 months <br /> to complete. The NRC staff expects to complete this review by approximately February 15, 2024. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date or significant changes in the forecasted hours, the reasons for the changes, along with the new estimates, will be communicated during the routine interactions with the assigned project manager.

These estimates are based on the NRC staffs initial review of the guidance document, and they could change due to several factors, including requests for additional information, unanticipated addition of scope to the review, and review by NRC advisory committees or hearing-related activities.

On June 22, 2021 (ADAMS Accession No. ML21146A261), the NRC approved the fee exemption in response to NEIs letter dated May 13, 2021 (ADAMS Accession No. ML21134A014),

requesting a fee exemption under Title 10 of the Code of Federal Regulations (10 CFR) 170.11(a)(1)(ii) for NRC review and endorsement of NEI 16-03, Revision 1. Based on NEIs supplemental letter dated December 5, 2022, this fee exemption is applicable for the review of NEI 16-03, Revision 1 including the attached excerpts from i-LAMP report. Please note that if the NRC approves NEI 16-03, Revision 1, it does not constitute approval of the EPRIs i-LAMP report.

If EPRI requests review and approval of the i-LAMP report, they would need to submit a separate fee exemption request independently from NEI 16-03, Revision 1, for NRCs review and consideration. This information was conveyed to both NEI and EPRI during the teleconference held on January 10, 2023.
