Dear Mr. Magnuson,
I am writing to provide you with an update on the May 31,2020, petition for rulemaking (PRM) that you submitted to the U.S. Nuclear Regulatory Commission (NRC) (Agencywide Documents Access and Management System (ADAMS) Accession No.ML20170B161).
On June18,2020, the NRC docketed your petition pursuant to §2.803 of Title10 of the Code of Federal Regulations (10CFR), "Petition for rulemaking NRC action," and assigned it Docket No.PRM50122. Please reference this docket number on any correspondence you may have concerning the petition. On August24,2020, the NRC published a notice of docketing and a request for comment for your petition, Accident Source Term Methodologies and Corresponding Release Fractions, in the Federal Register (85FR52058). The comment period closed on November9,2020.
In your petition, you requested the NRC amend its regulations to 1)codify source term methodologies and the corresponding release fractions in Sandia National Laboratories Report SAND2008-6601, Analysis of Main Steam Isolation Valve Leakage in Design Basis Accidents Using MELCOR 1.8.6 and RADTRAN, dated October 2008 (ADAMS Accession No.ML083180196) and 2)codify a modified version of Draft Regulatory Guide DG-1199 (Proposed Revision1 of Regulatory Guide 1.183, Dated July 2000), Alternative Radiological Source Terms for Evaluating Design Basis Accidents at Nuclear Power Reactors, dated October 2009 (ADAMS Accession No.ML090960464) that would include the source term methodologies recommended in SAND2008-6601 and the corresponding release fractions.
I am also informing you about a public meeting the NRC has scheduled on the revision to Regulatory Guide 1.183, Alternative Radiological Source Terms for Evaluating Design Basis Accidents at Nuclear Power Reactors. The public meeting is scheduled for 1:00pm

The NRC is reviewing your petition and the public comments received in response to the August24,2020, Federal Register notice. The Commission makes the final decision on the NRCs actions on petitions for rulemaking. After reviewing the merits of your petition and the public comments, the NRC staff prepares a recommendation to the Commission and the Commission will then make and issue its decision.
