Mr. Bob Dyer i

Safety and Health Division Oak Ridge Operations Office Department of Energy P. O. Box E Oak Ridge, TN 37831

Dear Mr. Dyer:

In accordance with our telephone conversation on April 12, 1989, regarding the status of actions by the Department of Energy (DOE) on Superior v'alve lots 17-22, enclosed is a copy of a letter faxed to us by Mr. W. " Bud" Allen of Superior Valve Company. Mr. Allen reported thtt a copy of this form letter was sent to lic.ensed f acilities of. the Nucles, Regulatory Commission (NRC) and other various cus, tomers of Superior Valve.

On the basis of this letter and our conversation, it is iny understanding that:

1.

DOE continues in its position that use of Superior Valves from heat lots 17 22 poses an unacceptable risk and that DOE will not accept from customers or use at DOE facilities cylinders fitted with valves from lots 17 22; and 2.

The studies and investigations by DOE's contractor, Martin Marietta Energy Systems, have not been successful in developing a cost-effective, nondestructive method that would distinguish acceptable valves from rejectable valves, and that no further efforts are planned in this regard.

As I indicated to you, the NRC Order of August 19, 1987, as modified September 25, 1987, which prohibits ARC licensees from using Superior valves from lots 17 22, remains in effect. Because of recent inquiries, it is necessary for us to update the status of this matter. Accordingly, please confirm the above points or provide the present DOE position and actions related to these Superior valve lots.

Sincerely, Or%M1Sistd8 Leland C. Rouse, Chief Fuel Cycle Safety Branch Division of Industrial and Medical Nuclear Safety, NHSS
