Dear Mr. Burnett:
As you are aware, Public Service Campany of Colorado (PSC) is actively pursuing the retToval of its inventory of highly enriched uranium (HEU) in the form of work-in-progress (WIP) from General Atomics' site.
General Atamics (GA) recently received a letter fram PSC (Reference 1, enclosed) advising GA that PSC and Nuclear Fuel Services (NFS) had signed a contract wherein it is agreed that cw1ership of the WIP will transfer to NFS upon delivery of the material to NFS in Erwin,
'Ibnnessee.
The contract calls for all shipuents to be completed by August 30, 1989. However, PSC expects to have all shipnents completed prior to August 1, 1989.
Concurrently, GA is in the process of reducing the r-ining inventory of HEU at GA to less than 5 kg U2as (exclusive, of course, of the strategic special nuclear material (SSNM) in the TRIGA Reactors facility; NRC License Nos. R-37 and R-68). This is being accomplished Ehrough a combination of downgrading (i.e., blending depleted U with HEU to yield IEU), shipnent to authorized disposal sites, and returning material to the Department of Energy.
GA expects that the inventory of SSNM, other than PSC's WIP, will be reduced to less than 5 kg by June 30, 1989.
The projected removals and downgrading of HEU will result in the inventory of material at GA's facilities being reduced to below the 25589 8906190036 890$O8 PDR ADOCK 07000734 C

'l Category 'I level (i.e., ( 5 kg SSNM). However, due to circumstances /
-factors beyond our control, it is not possible to specify the exact date when the quantity of material will reach a Category II level; but, it is expected to be no later than August 1, 1989.
n In view of the above described ongoing accions to reduce the inventory of material at GA to a Category II (or III) level, we hereby request relief from implementing the comparability upgrade requirements of 10 CFR Part 73, Section 73.46, and Appendices B and H.
4 GA's " Fixed Site and Transportation Plan for the Protection of Special Nuclear Material of Moderate and Iow Strategic Significance," dated February 1983, has been revised (May 1989) to reflect the manner in which we would operate as a Category II/III facility.
We hereby subnit the revised plan (five copies enclosed) for your review and approval.
'Ib assist you in your review of our. revised plan, also enclosed is a list of. revisions (section by section) with a brief description of each change.
Effective with our change of status (i.e., upon the SSNM inventory dropping below the Category I level and the revised (May 1989)
Category II/III physical protection plan being approved), the following two GA plans are to be rescinded:
(1) Category I Fixed Site Facility Physical Protection Plan (U), Revision B, dated 1982, and (2)
Category I Shutdown Facility Physical Protection Plan, dated May 1985.
A check in the amount of $150 for the administrative fee is being subnitted to you under separate cover.
Your early approval of our revived Category II/III physical protection plan is essential to an efficient and timely transition in our manner of operation.
