Dear Mr. Dinitz:

On January 26, 1982, the Vallecitos Nuclear Center (VNC) notified the NRC Office of State Programs (Ref. 5) that License SNM-960 had been amended on June 19, 1981, so that VNC was no longer a " plutonium processing and fuel fabrication plant" pursuant to 10CFR140.3(h) and requested that Indemnity Agreement G-4 (Ref. 1) be cancelled.

On October 20, 1982, the NRC responded (Ref. 6) stating that "the Commission

...will not provide indemnity protection for (the) plutonium processing facility" and that the NRC intended to cancel the agreement. However, in July,1984, VNC received a billing (#C0266, Ref. 3) for $15,000 for G-4 for the period 8/2/82 through 7/31/85. At VNC's request the billing was put on hold and a resolution of the situation by the NRC was promised.

As the NRC's Aention was clearly stated in this matter in their letter of October 20, 1982, and the need and requirement for such an indemnity disappeared even earlier, we were surprised when in July,1987, VNC received a second copy of billirg #C0266 and an additional billing (#F1392, Ref. 4) for $15,000 for the period 8/1/85 through 7/31/88.

1 As the site has not met the definition of 10CFR140.3(h) since 1981 and, in fact, the facility has been dismantled, VNC feels it has no obligation pursuant.to law or regulation to make the requested payments.

We are extremely interested in resolving this. issue and hereby request that

.the NRC cancel billings #C0266 and #F1392 and confirm that Indemnity Agreenent G-4 is null and void.
