Dear Ms. Garde:

This is in further response to your letter dated July 23, 1986, in which you appealed Mr. Donnie H. Grimsley's letter dated June 23, 1986.

Mr. Grimsley's letter denied documents in whole or in part that were subject to your Freedom of Information Act (FOIA) request for documents related to the NRC Comanche Peak Task Force. My letter to you dated April 10, 1987, addressed the agreement which was the basis for deleting certain information in the requested documents. This letter will address the portions of one document listed on Appendix P which was initially denied pursuant to an F0IA exemption.

Acting on your appeal, I have carefully reviewed the record in this case l

and have determined that the previously withheld information in the one document will continue to be withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C. 552(b)(5)) ano 10 CFR 9.5(a)(5) of the Commission's regulations.

Your appeal is, therefore, denied.

As stated in Mr. Grimsley's letter dated June 23, 1986, the withheld

portions of this docrment relate to the subject of potential violations.

The withheld information was predecisional to the issuing of the enforcement action on Comanche Peak.

Exemption (5) shields from mandatory disclosure information generated in the deliberative process i

that precedes most decisions of government agencies.

This is a final agency action. As set forth in the F0IA (5 U.S.C.

55E(a)(4)(B)), judicial review of this decision is available in a district court of the United States in the district in which you reside or have your principal place of business or in the District of Columbia.

Dear Mr. Stello:

This is an appeal pursuant to subsection a(6) of the Freedom of Information Act as amended (5 U.S.C.

522), of the actual denial of the Commission to release documents requested on q

January 21, 1985 by the Government Accountability Project (GAP) i regarding the Comanche Peak Task Force established in March 1984, and documents requested on April 22, 1985 regarding the allegation tracking system.

By letter dated June 23, 1986, Mr. Donnie Grimsley, Director of the Division of Rules and Records advised us that records subject to the two requests were designated as Appendices P and Q.

Mr. Grimsley informed us that portions of the July 11, 1985 and July 11, 1986 list of allegations which pertained only to 85-299, were withheld pursuant to FOIA Exemption 7(A) because their release would interfere with an ongoing investigation.

He advised that portions of 1 document contained in Appendix P were being withheld pursuant to FOIA Exemption 5 because they contain the advice, opinions and recommendations of the staf f concerning potential violations.

In addition he advised that of the 238 documents listed on Appendix P portions of 74 docu-ments and 23 documents in their entirety were being withheld pursuant to an agreement reached between the staff and myself at a May 8, 1985 meeting, that the names and identifying details of allegers and other individuals would be protected.

Mr. Grimsley also advised that of the 203 documents listed on Appendix Q portions of 100 documents 'and 26 documents in their entirety were being withheld pursuant to the May 8,

1985 agreement.

, please be advised that-' the agreement reached at t he May 8, 1985 meeting was that the confidentiality of allegers would be protected from disclosure and at no time was it meant to extend to " interviewees and other individuals" as your letter infers.

To the extent the-documents withheld pursuant to the May 8, 1985 relate to anyone but "al'legers" we appeal their denied release.

We believe we are entitled to release of the portions of documents being withheld.

We expect your response to this appeal within 20 working days of your receipt so that we can determine whether to. pursue this matter further in the courts.

This is in further response to your letter dated January 21, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), records related to the NRC Comanche Peak Task Force established in March 1984 (F01A-85-59) and your letter dated April 22, 1985, in which you requested, pursuant to the F0IA, all records related to the allegation tracking system for reflecting the status and identification of all allegations on the ComanchePeakplant(F01A-85-299).

Certain records subject to the two FOIA requests identified above are described below and on the enclosed Appendices P and Q.

With regard to F01A-85-299, the following records are being made available for public inspection and copying at the NRC Public Document Room (PDR) in folder F01A-85-299 under your name.

June 11, 1986, list of allegations on the Comanche Peak plant The above records list allegations which are contained in the tracking system y

maintained by the NRC's Office of Investigations (01). The 1985 list provides the status of cases at that time; the 1986 list provides the current status of 01 cases. Where entire entries have been deleted, those entries pertain to plants other than Comanche Peak and, therefore, are outside the scope of F01A-85-299. With regard to additional deletions on the 1985 list for cases which were then open, you may. refer to the 1986 list for the subjects of those cases. Where the deletion has been made at the entry on the 1986 list that pertains to the one remaining open case, the deleted information is bein withheldpursuanttoExemption(7)(A)oftheFOIA(5U.S.C.552(b)(7)(A)g) and 10 CFR 9.5(a)(7)(1) of the Commission's regulations. Release of the information would interfere with an ongoing investigation and could allow those being investigated to learn the scope, direction, and focus of investigatory efforts and thus could possibly allow them to take action to shield potential wrongdoing or a violation of NRC requirements from investigators.

Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for the denial is Mr. Ben 8. Hayes, Director. 01.

Any such appeal must be in writing, addressed to the Secretary of the Comission, U.S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

The remaining records subject to F01A-85-299 are also subject to F01A-85-59 and are being addressed under that FOIA request. Therefore, we are taking no further action on FOIA-85-299 or your letter dated March 3, 1986, appealing our lack of response to F01A-85-299.

With regard to F01A-85-59, with the exception of those records which are discussed below as well as those records which are identified by asterisks on Appendices P and Q and undergoing further review, we are placing the records identified on Appendices P and Q in the PDR in folder F01A-85-59 under your name.

Portions of the record identified at number 182 on Appendix P are being withheld from public disclosure pursuant to Exemption (5) of the F0IA (5 U.S.C.552(b)(5)) and IU CFR S.5(a)(5) of the Comission's regulations. The withheld portions contain the advice, opinions, and recomendations of the staff concerning potential violations. The nonexempt portions of this record are being placed in PDR folder F01A-85-59.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information is exempt from production or disclosure and that its production or disclosure is contrary to the public interest.

The persons responsible for this denial are the undersigned and Mr. Harold R. Denton, Director, Office of Nuclear Reactor Regulation.

This denial may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
