Dear Mr. Langley:

L This is reference to the telephone call you had with Mr. J. Pelchat of my staff on August 10,

.1999, regarding the magnesium-thorium scrap metal and dross currently being stored at your facility. The applicable regulation for magnesium-thorium is'10 CFR 40.13(c)(4) which indicates

. that products containing magnesium-thorium alloy, that do not exceed 4 percent by weight, are exempt from regulation; however chemical, physical, and metallurgical treatment or processing

' is not authorized. For this reason, the metal should be disposed of as radioactive waste.

We have discussed the issue with Mr. Keith Rose, Radiation Protection Officer at the U. S. Army Redstone Arsenalin Alabama. Mr. Rose believes that the magnesium-thorium scrap metals

. found at Southem Aluminum Casting were Army materials, but he was unable to determine the exact origin of the material or the reason the material ended up in your possession. Mr. Rose is working with the Army to evaluate taking possession of your magnesium-thorium scrap metal and dross. He has informed me that the Army has taken samples of the material for the purpose of determining the cost of disposal. Once this is determined, a schedule for removal will be established. He has also committed to keep me advised of the Army's plans.
