SUBJECT: NOTICE OF VIOLATION (INSPECTION REPORT 50-285/86-01)
This refers to the inspection conducted on January 6-10, 1986, of activities
authorized by NRC Operating License No. DPR-40 at the Fort Calhoun Station.
During this inspection, violations of NRC requirements were identified.
Inspection Report 50-285/86-01 documenting these findings was sent to you on
March 27, 1986. An enforcement conference to discuss these matters with you
was held on April 11, 1986, at the NRC Region IV office.
Violation I involves your failure to identify a radioactive shipment and to
perform the required radiological surveys. Violation II involves your failure
to properly control a very high radiation area.
In accordance with the
" General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1985), these violations described in the enclosed Notice
have been classified at Severity Level III. Normally, a civil penalty is
considered for a Severity Level III violation or problem. However, after consulta-
tion with the Director, Office of Inspection and Enforcement, I have decided that
a civil penalty will not be proposed in this case because of your prior good
performance in the area of radiological controls as evidenced by your Category 1
rating for the most recent Systematic Assessment of Licensee Performance.
Violation III involves your failure to provide workers with the appropriate
radiation termination exposure reports and is characterized as a Severity
Level IV violation.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing your response.
In your response,
you should document the specific actions taken and any additional actions you
plan to prevent recurrence. After reviewing your response to this Notice,
including your proposed corrective actions, the NRC will determine whether
further NRC enforcement action is necessary to ensure compliance with KRC
regulatory requirements.
