REVISIONS OF FUNDAMENTAL NUCLEAR MATERIAL CONTROL PLAN (TAC NO L30993)
Dear Ms. Elliott:
This refers to your cubmittal dated July 31,1997, as modified by your subsequent letter and enclosure dated December 13,1997, in wh!ch you submitted a totally revised Fundamental Nuclear Material Control (FNMC) Plan. This Plan was properly submitted pursuant to the provisions of 10 CFR 70.34. We have completed our review of the revised Plan, and have found it to be acceptable. Accordingly, pursuant to Part 70 to Title 10 of the Code of Federal Regulatiors, Materials License SNM 1168 is hereby amended to incorporate your revised FNMC Plan. Thus, Safeguards License Condition SG-1.1 has been revised to raad as follows:
GG-1.1 The !icensee shall follow Chapters 1.0 through 9.0 of its Fundamental Nuclear Material Control Plan with all pages designated as Revision 12 and dated December 13,1997. This Plan may be further revised in accordance with, and pursuant to, tne provisions of either 10 CFR 70.32(c) or 70.34.
All other conditions to this license remain the same.
Enclosed are copies of the revised Materials License SNM-1168 and the Safeguards Evaluation Report, which includes the Categorical Exclusion.
We agree with your determination that the enclosures to your letters contain information of the type specified in 10 CFR 2.790(d) which is deemed to be commercial or financial within the meaning of 10 CFR 9.17(a)(4). Accordingly, said enclosures will be held from pubiic disclosure unless subject to the provisions of 10 CFR 9.23.
