POLICY AND GUIDANCE DIRECTIVE 012: FOLLOWUP ACTIONS FOR ORDERS SUSPENDING AND REVOKING LICENSES FOR NONPAYMENT OF FEES (REVISION OF P&GD 93 01)

The attached directive provides guidance concerning procedures for coordinating with the Office of the Chief Financial Officer on Orders suspending and revoking licenses for nonpayment of fees. The Order (attached) includes a number of significant changes. Rather than suspending licenses until termination, the new Order suspends licenses for 30 days to make it clear that licensees cannot operate without paying fees and must take steps to decomrnission. After 30 days, if the licensee does not pay debts to NRC, the Order automatically revokes licenses. Licensees are still obligated to follow NRC requirements and the conditions of licenses and are subject to enforcement action and action to recover fees. If licensees pay their debts to NRC after the 30-day period and want to resume operations, they must apply for and be issued a new license. The Order and PG&D do not apply to Part 72 licenses. As noteiin the PG&D, actions on sealed source and device registrations and quality assurance approvals may deviate from these procedures. Corresponding changes will be made in the Orders for quality assurance approvals, sealed source and device registrations, and exempt distribution licenses.
